COMMON JUDGMENT
Respondent No.2 was an employee of the petitioner. The petitioner terminated the service of respondent No.2. Respondent No.2 challenged the termination by filing Industrial Dispute No.21/2017 before the Labour Court, Ernakulam. As per award dated 25.02,2020, the Labour Court ordered to reinstate respondent No.2. The petitioner challenged the order by filing W.P(C) No.28507/2020 before this Court. This Court set aside the order and remanded the matter to the Labour Court to consider afresh.
2. The Industrial Dispute proceedings are now pending before the Labour Court. In W.P(C) No.28507/2020, this Court had directed the petitioner to give the benefits as provided under Section 17-8 of 2025 : KER: 61557 W.P (C) No.35371 of 2024 a Con.Case (C) No.2006 of 2024 the Industrial Disputes Act. When the petitioner failed to comply with the said direction, respondent No.2 filed Con,Case (C) No.2006/2024.
3. Now, the parties have arrived at a settlement. The petitioner agreed to pay Rs.5 Lakhs to respondent No.2 as full and final settlement of all his claims and entitlements on account of his employment and service. Respondent No.2 received the amount as full and final settlement of all his entire claims,
4. A joint petition of compromise has been placed on record. I have gone through the terms in the compromise. The terms entered into between the parties are valid and lawful. Therefore. the compromise entered into between the parties is recorded. In view of the agreement entered into between the parties, the proceedings in the I.D No.21/2017 stands quashed.
The Writ Petition (Civil) and Contempt Case (Civil) are disposed of in accordance with the compromise entered into 2025 : KER: 61557 W.P (C) No.35371 of 2024 & Con.Case (C) No.2006 of 2024 between the parties. The compromise will form part of the judgment.
