Information sought

:

1. The Appellant filed an RTI application dated 06.10.2023 (offline) seeking the following information:

"सीमा सडक संगठन के केन्द्रीय कमी के ऊपर लागू दो नीति दो नाम अन्द्य बिन्द्दओ ु पर सूचना पाने के संम्िन्द्ध में बिनम्रिा पूर्क व अर्गि कराना है कक Page 1 of 5 उपरोक्ि बिषय पर मै केन्द्रीय कमी ने सलग्न प्रति आरटीआई आर्ेदन प्रधानमंत्री भर्न नई ददल्ली ददनांक-30/03/2022 को आर्ेदन करने पर उच्च स्िर के अधधकारी द्र्ारा केन्द्रीय कमी की फररयाद आर्ेदन को कुचलने प्रिाड़िि के ललए पत्र 1203/18/ई1 सी ददनांक 04/05/2022 को लसक्यूररटी एक्ट गम्भीर आरोपो में फंसाकर प्रिाड़िि ककया जा रहा हूं माननीय महोदय मै केन्द्रीय कमी सूचना पाने के ललए भा पो आ संख्या 27एफ 369418 सलग्न कर आर्ेदन जररये डाक द्र्ारा प्रेषषि कर रहा हूं

1. माननीय महोदय भारिीय संषर्धान िथा केन्द्रीय लसषर्ल सेर्ा िथा सीमा सडक संगठन नीति नैसधगवक न्द्याय लसद्धांि के मुिाबिक केन्द्रीय कमवचारी से भारिीय थल सेना की नीतियों का पालन करार्ाया जा सकिा है अथर्ा नही सूचना उपलब्ध कराने की कृपा करे I

2. माननीय महोदय मै केन्द्रीय कमी सीमा सडक संगठन को भारिीय थल सेना जर्ान की भांति स्िंभ / टोपी/िेल्ट/शूज/र्दी धारण करर्ाया जा सकिा है अथर्ा नही सूचना उपलब्ध कराने की कृपा करे I

3. माननीय महोदय मै केन्द्रीय कमी के बिभाग सीमा सडक संगठन िथा जनरल ररजर्व इंजीतनयर फोसव दो नाम दो नीति भारिीय संबिधान नैसधगवक न्द्याय लसद्धांि अनुसार सही है अथर्ा नही सूचना उपलब्ध कराने की कृपा करे I

4. माननीय महोदय मै केन्द्रीय कमी सीमा सडक संगठन से भारिीय थल सेना जर्ान समिुल्य जोखिम ड्यूटी करर्ाया जा सकिा है अथर्ा नही सूचना उपलब्ध कराने की कृपा करे I

5. माननीय महोदय केन्द्रीय कमी सीमा सडक संगठन समान कायव के ललए समान िेिन भत्ता का अधधकार है कक नही सूचना उपलब्ध कराने की कृपा करे

6. माननीय महोदय मै केन्द्रीय कमी सीमा सडक संगठन बिभाग है अथर्ा भारिीय थल सेना के अधीन बिभाग है सूचना उपलब्ध कराने की कृपा करे

7. माननीय महोदय मै केन्द्रीय कमी सीमा सडक संगठन के ऊपर भारिीय थल सेना नीति लगाया जाना भारिीय संषर्धान केन्द्रीय लसषर्ल सेर्ा अनुसार सही है सूचना उपलब्ध कराने की कृपा करे "

2. The CPIO furnished a reply to the Appellant on 12.10.2023 stating as under:

"अर्गि कराया जािा है कक:-

(क) सीमा स़िक संगठन (BRO), सीमा स़िक षर्कास मण्डल (BRDB) का कायवकारी अंग है । इस संगठन को सूचना का अधधकार अधधतनयम, 2005 की धारा 24 िथा दस ू री अनुसूची के अनुसार, भ्रष्टाचार और मानर्ाधधकार उलंघन के अलभकथनों से सम्िंधधि सूचना के अतिररक्ि, अन्द्य जानकारी उपलब्ध कराने हे िु इस अधधतनयम से पूरी छूट लमली हुई है ।

(ि) केन्द्रीय सूचना आयोग के अनुसार सूचना का अधधकार अधधतनयम 2005 का उपयोग सेर्ा संर्ंधधि मुददों या लशकायि तनर्ारण हे िु करना उधचि नहीं है। आपके आर्ेदन का अर्लोकन करने पर यह भी पाया गया कक आपने आरटीआई अधधतनयम 2005 की धारा 2 (एफ) के अनुसार जानकारी नहीं मांगी है , िल्ल्क कुछ प्रश्नों के उत्तर मांगे हैं। उक्ि अधधतनयम के प्रार्धानों के अनुसार उन्द्हीं जाजककाररयों की पूतिव की जा सकिी है जो भौतिक रूप में इस संगठन में आसानी से उपलब्ध हैं। इसके अतिररक्ि, ककसी भी िरह की जानकारी का संकलन अथर्ा पररकलन अथर्ा सज ृ न अथर्ा कारण ििाना, स्पष्टीकरण दे ना, प्रश्नों का उत्तर दे ना और सलाह दे ने सम्िंधी कारवर्ाई सूचना के अधधकार की पररधध में नहीं आिा है । िदनुसार आपके आर्ेदन का तनस्िारण ककया जािा है ।"

3. Being dissatisfied, the appellant filed a First Appeal dated 03.11.2023. The FAA vide its order dated 01.12.2023, held as under:

"आपको सूधचि ककया जािा है कक अधोहस्िाक्षरी ने आपके द्र्ारा प्रेषषि ऑफलाइन आर.टी.आई. अनुरोध ददनांककि 06 अक्टूिर 2023 से सम्िंधधि आपके मामले का गहराई से अध्ययन ककया है , ल्जसका तनपटारा इस मुख्यालय के केंरीय लोक सूचना अधधकारी द्र्ारा उत्तर प्रस्िुि करिे हुए उनके पत्रांकः 11022/सी.स.म./आर्ेदन/आनलाइन/133/सू.अ.प्रकोष्ठ ददनांककि 12 अक्टूिर 2023 के िहि कर ददया गया है ।

उक्ि अधधतनयम के प्रार्धानों के अनुसार आपके द्र्ारा मााँगी गई उन्द्हीं जानकाररयों की पूतिव की जा सकिी है जो भौतिक रूप में इस संगठन में आसानी से उपलब्ध हैं। इसके अतिररक्ि, ककसी भी िरह की जानकारी का स्पष्टीकरण Page 3 of 5 दे ना, प्रश्नों का उत्तर दे ना और सलाह दे ने सम्िंधी कारव र्ाई सूचना के अधधकार की पररधध में नहीं आिा है ।

आपके उपरोक्ि आर्ेदन के अर्लोकन से ज्ञाि होिा है कक आपने र्ैसी जानकारी जो भौतिक रूप में उपलब्ध है उसको प्राप्ि करने हे िु आर्ेदन नहीं ददया है र्ल्ल्क आपने प्रश्नो का उत्तर मॉगा है जो सूचना के अधधकार में नहीं आिा है ।

सूचना के अधधकार के िहि सेर्ा संिंधी जानकारी/लशकायि तनर्ारण हेिु आर्ेदन संगि नही है । आपके द्र्ारा प्रेषषि ऑफलाइन आर.टी.आई. अनुरोध का तनपटारा करिे समय केंरीय लोक सूचना अधधकारी द्र्ारा अधधतनयम के समिद्ध प्रार्धानों का पूणव अनुपालन ककया गया है ।

आपके द्र्ारा प्रेषषि अपील पर ककसी प्रकार की कायवर्ाई शेष नहीं है िदनुसार आपके अपील को तनस्िाररि ककया जािा है ।"

4. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Present through video conference. Respondent: Shri Rishi Gupta, Nodal Officer/CPIO and Shri Manoj Kumar, Superintendent, appeared in person.

5. The Appellant inter alia submitted that he was not satisfied with the reply given by the Respondent authority.

6. The Respondent while defending their case inter alia reiterated the reply given dated 12.10.2023 by the CPIO and the order dated 01.12.2023 passed by the FAA.

During the hearing on various queries from the Bench the Respondent submitted that the age of superannuation for the staff is 60 years which gives better job security than available to their counterparts in military services; BRO staff gets access to canteen services like the military services which is not available to their counterparts in Civilian employment; and BRO staff is entitled to concessional travel and stay in transit accommodation.

Decision:

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that queries raised by the Appellant in his RTI application are in the form of seeking explanations, clarifications, and legal interpretations, which do not qualify as "information" as defined under Section 2(f) of the RTI Act, 2005.

9. It is noted that Border Roads Organisation (BRO) being subordinate and executive arm of Border Roads Development Board (BRDB) which is included in 2nd Schedule of RTI Act and thus, is exempted from its operation under Section 24 except the cases of human right violation and allegation of corruption. Since the Appellant did not raise any such allegations, the exemption claimed by the Respondent stands valid. Therefore, the Commission finds no ground to intervene.

The appeal is dismissed accordingly.
