(38) CIC/DSLSA/A/2021/114539/HCDEL The Appellant filed an RTI Application dated 30.12.2020 seeking details of the action taken on the letter dated 31.07.2020 regarding transfer of his earlier RTI application dated 17.06.2020 from CPIO and US, NALSA to PIO, DSLSA.
Having not received a response from the PIO, the Appellant filed a First Appeal dated 11.02.2021 which was not adjudicated by the First Appellate Authority.
Aggrieved and dissatisfied, the Appellant approached the Commission with the Second Appeal.
Facts emerging in Course of Hearing:
The Appellant remained absent during the hearing despite prior intimation.
The Respondent represented by Smt. Sanghamitra, ACP, South West District; Smt. Sanjita, ACP, Vigilance; Shri Vivek Singh, Inspector, Vasant Kunj North PS; Shri Madan Mohan, ASI, PHQ; Shri Rajesh Kumar, Inspector, RTI Cell, PHQ; Shri Prashant, HC, RTI Cell, Vigilance and SmtGeeta Rajput, PIO and Supdt, DLSA participated in the hearing through video conference. The Respondents reiterated the replies available on the Commission's record and stated that available information was provided to the Appellant. In addition, it was stated that the Appellant was in a habit of filing multiple RTI applications on similar issues which was impeding their administrative functioning and disproportionately diverting their meagre resources. Smt Rajput added that the Appellant had approached them for legal aid through the NALSA portal and LAC Shri Vikram Singh tried to contact the Appellant on his given phone number but he never responded to the calls. The RTI application of the Appellant dated 17.06.2020 was replied to on 19.08.2020. The Appellant then filed a fresh RTI application dated 15.10.2020 which was replied to on 12.11.2020 but could not be delivered due to some typographical error in the address. He subsequently filed a first appeal dated 05.08.2020 and in compliance with the FAA's order dated 05.01.2021, information was provided to the Appellant on 08.01.2021.Page 27 of 28
Decision:
Perusal of documents and averments made during hearing indicates that replies have been duly provided to the Appellant, in terms of provisions of the Act in the aforementioned cases. Records reveal that the Appellant has been filing numerous cases in order to seek redressal of his grievances, from various public authorities some of which are not even the actual custodian of information. Notwithstanding the multiplicity of cases filed, inevitably he remains absent during the hearings of his cases. In Second Appeal No CIC/PRSEC/A/2021/123705 CIC/PRSEC/A/2021/129251 CIC/PRSEC/A/2021/129250 decided on 08.09.2022 and CIC/SCOFI/A/2021/127572 CIC/DSLSA/A/2021/127261/HCDEL CIC/DSLSA/A/2021/123696/HCDEL CIC/DSLSA/A/2021/114540/HCDEL CIC/DSLSA/A/2021/114538/HCDEL CIC/DSLSA/A/2021/100662/HCDEL decided on 08.09.2022, the Commission while relying on the judgement of the Hon'ble Supreme Court in Central Board Of Secondary Education & Anr. vs Aditya Bandopadhyay & Ors directed the Appellant not to disproportionately divert the resources of the public authorities by filing multiple RTI applications on similar issues. A reference was also made to the judgement of the Apex Court in Union of India vs Namit Sharma (Review Petition [C] No.2309 of 2012) dated 03.09.2013 wherein it was held that the Information Commission does not decide a dispute between two or more parties concerning their legal rights other than their right to get information in possession of a public authority. Yet, it is found that the Appellant has undermined the spirit of the RTI Act by clogging the system with a barrage of RTI applications, merely claiming irregularities within the JNU administration.
In the light of the aforementioned decisions, and the fact that more than 118 cases of the same Appellant on the same subject matter have so far been adjudicated by different Information Commissioners of this Commission, the Commission is not inclined to entertain any further adjudication on the same subject, since no cause of action subsists under the RTI Act.
Hence, all the above-mentioned appeals are disposed off as such.
