1. Learned Counsel for both sides are present and are heard.
2. The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-
"(a) An order quashing and/or setting aside the Office Memorandum dated 08.07.2025 as well as the Adverse Entries dated 17.07.2025.
(b) An order directing the respondents to produce/cause production of all relevant records.
(c) Any other order or further order/orders as to this Hon'ble Tribunal may seem fit and proper".
3. The submissions made by Learned Counsel for the applicant are summarized below:-
3.1 The applicant was issued with a warning letter by the Director of the organization on the grounds that the applicant has committed serious misconduct and breached the conduct rules by participating in an agitation by contractual staff during 1st to 3rd January, 2025. 3.2 The applicant denied the allegations vide his letter dated 14/07/2025 in spite of his denial without giving him any opportunity to defend himself. An adverse report was drawn up against him by the Collegium Committee.
3.3 His representations against the adverse comments have not elicited any positive response so far. In fact, his representation has been rejected vide letter dated 02/12/2025.

4. The submissions made by Learned Counsel for the respondents are summarized below:-
4.1 The applicant has not exhausted although admissible remedies were available to him.
4.2 The avenue of consideration by DGCSIR is still open to the applicant.

6. Learned Counsel for the applicant vehemently objects to the proposal made by Learned Counsel for the respondents to remit the matter back to DGCSIR.
7. In view of the submissions made by Learned Counsel for the respondents, we deem it fit to dispose of this original application by directing DGCSIR to consider the representation of the applicant in the matter.
8. The applicant is at liberty to file a comprehensive representation addressed to DGCSIR conveying his grievance contained in this O.A. within a period of 15 days from the date of receipt of a copy of this order.
9. DGCSIR is directed to consider and dispose of the representation of the applicant by way of a reasoned order within a period of 45 days of the receipt of the representation. The speaking order is to be communicated to the applicant within the said period.
10. With these directions, the O.A. is disposed of. There shall be no order as to costs.
