The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case arising out of FIR No.8 dated 19.4.2010, registered at Police Station Mattaur, District Sahibzada Ajit Singh Nagar (Mohali), under Sections 406, 408, 409, 420, 467, 468, 471 and 120-B IPC.

It is not denied that the petitioner is in custody since 27.6.2011. The prosecution, in all, has cited 56 witnesses but till today none has been examined. It is a case of Magisterial trial. The trial of the Criminal Misc. No. M- 38104 of 2011 2 case will take a long time to conclude. It is stated that co-accused of the petitioner have already been granted regular bail by this Court.

Learned counsel for the petitioner has relied upon a judgment rendered by Hon'ble the Apex Court in Sanjay Chandra v. Central Bureau of Investigation (Criminal Appeal No. 2178 of 2011 arising out of S.L.P. (Crl.) No. 5650 of 2011, decided on 23.11.2011) (Annexure P6) to contend that right of bail is not to be denied merely because the amount of fraud is on the higher side.

After hearing learned counsel for the parties, this Court is of the view that further detention of the petitioner is not warranted. Hence, the present petition is accepted. Petitioner is ordered to be released on regular bail to the satisfaction of the Chief Judicial Magistrate/Illaqa Magistrate, Sahibzada Ajit Singh Nagar (Mohali).
