PERMOD KOHLI.J (ORAL) C.M. No. 1970-71 of 2009 Application allowed.

Annexure P-2 is taken on record.

CWP No. 21463 of 2008 Notice of motion.

Mr. B.S. Chahal, D.A.G., Punjab accepts notice on behalf of the respondents.

The petitioner has approached this Court seeking direction for payment of his pensionary and other retiral benefits. Admittedly, petitioner's services were terminated on account of his conviction in the criminal case. The termination order is not under challenge. At this stage learned counsel for the petitioner submits that petitioner is entitled to some compassionate allowances under rule 2.5. His earlier application (Annexure P-1) for consideration of pension and other retiral benefits has also not been considered. He further submits that petitioner may be allowed to make CWP No. 21463 of 2008 -2- representation for compassionate allowances for consideration of the respondents.

This petition is accordingly disposed of with liberty to the petitioner to file a representation within two weeks to the respondent no.2, who shall examine the same and if the petitioner is entitled to any compassionate allowances under any rule or law, the same may be considered and his representation may be disposed of in accordance with law within two months of the date of the representation.
