An objection had been taken on behalf of the Indian Statistical Institute on the last occasion, i.e., 6th April, 2022 on behalf of the private respondents as well as the ISI that this Court does not have the determination to hear the writ petition. It was noted in the order that the point of jurisdiction was taken after several days of hearing when counsel was present on behalf of ISI as well as the private respondents.
Learned counsel appearing for the petitioner hands up a compilation of documents today in Court when the matter is taken up. The compilation indicates that ISI took the point of 2 lack of determination before a learned Single Judge when the learned Judge was taking Group- VI matters. The matter was released by the learned Judge on that basis. The ISI again took the point of lack of determination before a learned Judge taking Group-II matters which was again released by the learned Single Judge. The petitioner was constrained to write to the Hon'ble Chief Justice for assignment on the matter. The matter was thereafter assigned to the learned Single Judge who had determination of Group-II matters.
This Court started hearing the matter from 26th November, 2021. There are at least eight orders in the compilation, if not more, of this court having considered the matter including passing a direction for affidavits.
It is evident from the list of documents, that ISI and the private respondent Nos. 11 and 12 in WPA 7682 of 2020 has taken an objection with regard to the determination of the Court before learned Judges taking up Group-II as well as Group-VI matters. The conduct of ISI and the private respondent being represented on several occasions and thereafter taking point after five months of hearing should firmly be deprecated. 3 The ISI shall accordingly pay Rs. 20,000/- to Ramakrishna Mission Siksha Mandir, Belur within a fortnight from date. The private respondent shall pay 7000/- to Bharat Sevashram Sangha within a fortnight from date.
List this matter on 29th April, 2022 as prayed for.
