1. The above case has been Suo Motu registered by this Tribunal on the basis of the newspaper report published in Dinamalar daily dated 1 09.04.2021 under the caption ""@ayen npgsapie aipeyser 3 svmfiser Flempilginj and also another newspaper report published in the Hindu Newspaper Chennai Edition dated 09.04.2021, under the caption "Dumping of garbage foiled near Anamalai, trucks seized", thereafter this Tribunal had directed the respective District Collectors, and the Pollu 'oards (PCBs), to submit their reports. Thereafter, the m iken up on 25.06.2021, and this Tribunal had considered in um by the respondents me ents ca directed to € > IONS mde and -- the | ctit c "or 3 avd acapeR) is also directed to file their further 2 actio a, taken report on the basis of the proceedings already initiated as mentioned in the present report, dated 21.06.2021.
22. The counsel appearing for the State of Tamil Nadu is directed to instruct their Officers not to send their reply statement, if any, to this Tribunal directly without informing them, as otherwise, the counsel representing the State Department may not be able to know about such reports and convince this Tribunal regarding the stand taken by such respondents.
23. The official respondents are directed to submit their independent reports as directed before this Tribunal on or before 29.07.2021 by e-filing in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF along with necessary hardcopies to be produced as per rules.

Sri. Ranjan Jacob Environmental Engineer, Kerala State Pollution Control Board, Regional Office, Ernakulam do hereby submit that I am authorized to represent the 4th 3 respondent and that I am conversant with the facts of the said case as available from the official records and I state as follows:
2. It is submitted that the office of District Collector, Thrissur had conducted enquiry into the subject matter and found that the waste was dumped by one Sri. Reghunath with whom Thrissur Corporation had entered into a contract for disposing the rejects of municipal solid waste. As per the records submitted by the Corporation to the Board, the contractor had ren 840 kg of waste from the Corporation area with e: 2020.
Hence the Board's Envi letter dated 10.06.2021 to gineer, Thrissur has issued a tion to offer its explanation for entering in Lar agreem Thee orpornt n authoritié bern Yletas per the : provisions of the Soli legal exclusionary clause clearly s states that the concessionaire shall show upmost caution and due diligence while handling transporting and processing the solid waste as per the agreement and hence the Corporation cannot be legally held responsible for the breach of contract done by the concessionaire. They have also stated that in the FIR, the name of Thrissur Municipal Corporation is nowhere mentioned .Copy of the reply from Thrissur Corporation dated nil is enclosed as Annexure 2.
It is also reported that they have withdrawn the agreement with Sri. Reghunath and took adequate legal steps to address the issue in an effective manner. The Corporation has requested not to proceed against them as they have withdrawn the agreement and moved legally Further evidence in this he police department is awaited.

Detailed raport submitted by the Tahsildar, Anaimalai in respect of Original Application Na.100/2021(8Z):
On the early hours of 08.04.2021, the Sub Collerter, Pollach! received a phone call (Secret Message) from the General Public of Marappggoundengudur Village of Anaimalai Taluk, Immediately the message was passed on to the then Tahsildar, Anaimalai for necessary action, The then Tahsildar, Anaimalal along with the Police reached the spot and made enquiries. The local public stepped three Tipper Lorriea hearing nos. KL-43-C-3222, KL-49-0-5807 and KL-08-A2-497, which carried the bio- medical as well as municipal solid wastes were illegally traneported from Serala and unautharisedly dumped it in the Patta lands in 5.F No. S.F No.779/B1, 546, 552/78, 552, §54/1, 540/A and 541 of Marappagoundenpudur Village near Rettairnadal Pirivu (Qyestinen. Life of Angimalai Taluk, which belongs to one Thiru. Shajl Antony, S/o Antony, who resides in Kerala State.
A verification of Vilage Records reveals that Tv Sunil Antony S/o. Antany, Shaji Antony 5/o, Antony, Stanly Antony 5/o. Antony, James George S/o, George Mathew, Tom George 5/o. George Mathew, Tmt. Jameela B/o. Kanthan Kudathukkara are the Joint Pattadhars, in respect of Patta Nos. 1017, 1019 and 1020, The extent of each survey field is as fallows:

Heres, if is evident that this process was going ar for a long time. The bio-medical as well as municipal solid wastes from Thrissur and Palakkad of Kerala State were illegally transported and dumped in the patta lands that are noted above unauthorisedly. Therefore, it is evident that the provisions of the Sold Waste Management Rules, 2016 were not adhered and itis a clear violation of Rules.
The 3 Tipper Lorrias along with the JC6, that are used for the ilegal transportation and unauthorized dumping, were seized and taken to custody and are parked in the Taluk Gifice, Anaimalal.

14.Time is granted to the Tamil Nadu Pollution Control Board (TNPCB) to come with the detailed report regarding the nature of pollution caused or contamination caused to the soil as well as the ground water in respect of which they proposed to conduct the test, so as to ascertain the damage ca nvironment and the persons from whom this compensat e to be recovered.
