(4)The undisbursed balance, if any, of the sum deposited shall be refunded to the party or parties who deposited the sum in the same proportion as that in which it was deposited.[Explanation.- The Labour Court may, if it thinks fit in a particular case for reasons to be recorded, direct that the entire fee payable to the Commissioner shall be paid only by the employer.] [Added vide Punjab Government Notification No. GSR 40/C.A. 14/47/Section 38/Amd.
