          State.

This bail application has been filed on behalf of the abovenamed applicant with prayer to release on bail in connection with Sadar P.S. Case No.24 of 2002 registered under Sections 147, 148, 149, 341, 342, 353, 332, 333, 124-A, 379, 307 and 302 of the Indian Penal Code, Section 27 of the Arms Act, Sections 3, 4 and 5 of the Explosive Substance Act, Sections 17(i)(ii) of the CLA Act and Sections 3(2-1)(3)(4)(5) of POTA pending in the court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged against 250 to 300 unknown persons of MCC banned extremist organization with these allegations that the police party was attacked by the members of banned extremist organization and fires between them were exchanged in which many of police personnel sustained injuries and also died.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged against unknown members of the banned extremist organization. The name of the applicant transpired during investigation in the confessional statement of co-accused. The applicant was neither apprehended at the spot nor there is any evidence against the applicant to establish his complicity in commission of the alleged offence. Co-accused Dular Khan @ Rupchand @ Dulare Khan @ Roopchand has already been granted bail by a co- ordinate Bench of this Court vide order dated 28.01.2021 passed in B.A. No.11935 of 2020. The applicant has been languishing in jail since 06.02.2021.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that in this case several police personnel sustained injuries and died.

In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
