Learned counsel for the petitioners states that he has instructions that the petitioners would not press this petition if two years' time is granted to them to vacate the premises in dispute.

At this stage Mr. R.P.Singh Ahluwalia, Advocate entered appearance on behalf of the respondent and when the offer was put to him he prayed for some time since his client was on the way. Now after lunch when the matter has been taken up learned counsel for the respondent has made a counter offer. He has stated that in case the petitioners vacate the C.R. No.6185 of 2012 (O&M) -2- premises in dispute on or before 31.12.2013 he would not only give up the rent till that date but would also waive the rent for the preceding 21 months which admittedly has not been paid by the petitioners.

Learned counsel for the petitioners on instructions from his clients has accepted this offer.

Resultantly, this petition is disposed of in the terms that the petitioners shall hand-over the vacant possession of the premises in dispute to the respondent on or before 31.12.2013 in consideration of the offer of the respondent that he would exempt the petitioners from paying the rent not only from today but also the arrears which are due as on date.

The parties are directed to file their respective undertaking in this behalf before the learned trial Court on or before 09.11.2012. In case the petitioners do not file the necessary undertaking on the said date this petition would be deemed to be dismissed. In case the respondent does not file the necessary undertaking on the said date this petition would be deemed to be admitted alongwith the further order of stay of dispossession.
