                            ORAL ORDER

The petitioner is before this Court calling in question the proceedings in C.C.No.61930/2024 registered for offences punishable under Sections 498A and 506 of the IPC read with Sections 3 and 4 of the Dowry Prohibition, Act, 1961.

2. Heard Sri. Sreedhar K., learned counsel appearing for the petitioner, Sri. Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Sri. Nimisha Kumar, learned counsel appearing for respondent No.2 and have perused the material on record.

3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint application for compromise along with the affidavits. The joint application for compromise so filed reads as follows:

"JOINT APPLICATION FOR COMPROMISE UNDER SECTION 528 R/W 321 OF BHARATIYA NAGARIK SURAKSHA SANHITA:

NC: 2026:KHC:6309 CRL.P No. 686 of 2026 HC-KAR The Petitioner and Respondent No.2 herein most respectfully submit this Joint Compromise Application seeking Quashing of the offences enumerated in the charge sheet filed by Respondent No.1 Police in Crime No.224/2023 for offences punishable under Sections 498A & 506 of IPC and Sections 3 & 4 of the Dowry Prohibition Act currently pending before, the IX Addl. Chief Metropolitan Magistrate in C.C. no. 61930/2024, Bengaluru as below:-
1. The Petitioner is presently facing trial in Crime No. 224/2023, registered by the East Division Women's Police Station, Shivajinagar, which has culminated in C.C. No. 61930/2024, for the offences punishable under Sections 498A and 506 of the Indian Penal Code and Sections 3 &

4 of the Dowry Prohibition Act, presently pending before the IX Additional Chief Metropolitan Magistrate, Bengaluru.

2. The Respondent No. 2 is no longer inclined to pursue the criminal proceedings, as the disputes between the parties have been amicably settled in MC no. 395/2024 and a decree of divorce has been granted to the Petitioner and the Respondent no. 2 in terms of the mediation agreement.

3. As per the agreed terms, the Petitioner had agreed to pay the Respondent no. 2 a sum of Rs. 35,00,000/- (Rupees Thirty-Five Lakhs only) towards the full and final settlement of all disputes between the parties including those arising out of the criminal proceedings and the matrimonial issues. Today, the Petitioner has paid a sum of Rs. 10,00,000/- (Rupees Ten Lakhs only) to Respondent No. 2, towards the last instalment, by way of RTGS transfer. The Respondent No.2 has already received a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs) earlier.

4. In the light of the aforesaid mentioned settlement, the Respondent No. 2 has formally withdrawn all allegations made in the complaint. The Petitioner also withdraws all allegations made against the Respondent no. 2. Consequently, the offences against the Petitioner under Section 506 may be compounded and Section 498A with -5- NC: 2026:KHC:6309 CRL.P No. 686 of 2026 HC-KAR the leave of this Hon'ble Court may be quashed, in the interests of justice. So also the offences under Sections 3 & 4 of the Dowry Prohibition Act with the leave of this Hon'ble Court may be quashed, in the Interests of justice.

5. Both the parties undertake not to interfere in each other's lives or make any kind of allegations against each other including against those closely connected to both the parties, not just limited to each other's family members but also the past and present staff and those involved as part of the support system for the parties either in the past or present.

6. The Petitioner humbly submits that the offence under Section 506 is compoundable and Section 498A IPC and Sections 3 & 4 of the Dowry Prohibition Act with the leave of this Hon'ble Court may be quashed, In terms of the law laid down by the Hon'ble Supreme Court in (2012) 10 SCC 303 (Gian Singh's case).

WHEREFORE, the Petitioner and the Respondent No.2 most humbly pray this Hon'ble Court be pleased to accept the joint compromise application and consequently Quash the offences against the petitioner in East Division Women's Police Station, Shivajinagar, in C.C. No. 61930/24, for offences punishable under Sections 498A & 506 of IPC and Sections 3 & 4 of the Dowry Prohibition Act, currently pending before the before the IX Additional Chief Metropolitan Magistrate, Bengaluru, in the ends of justice."

4. In the light of joint application for compromise being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the joint application for compromise and terminate the proceedings against the petitioner in the subject petition.

5. For the aforesaid reasons, the following:

ORDER i. Criminal Petition stands disposed.
ii. Proceedings pending in C.C.No.61930/2024 before the VI Additional Chief Metropolitan Magistrate, Bangalore, qua the petitioner stand quashed.
