1. Heard Mr.Nitansh Jaiswal, learned Deputy Government Advocate 2 for the State as well as Dr.N.K.Shukla, learned Senior Advocate assisted by Mr.Kabeer Kalwani, learned counsel for the respondent.

2. In compliance of the Court's order dated 12.02.2026 Mr.Rajwardhan Singh, Advocate, is present in person and has filed the affidavit, which is reproduced hereinbelow:-

"1) That, I am the respondent in the instant contempt petition am and I circumstances of the case. well conversant with the facts and circumstances of the case.
2) That, the instant contempt case was listed before the Hon'ble Court on 12.02.2026 and it was directed by this Hon'ble Court for the personal appearance of the Respondent on the next date of hearing i.e. on 19.02.2026 and it has been further directed by this Hon'ble Court for the respondent to file a fresh unconditional apology affidavit.
3) That, in compliance of the order dated 12.02.2026 the Respondent is hereby furnishing the instant affidavit.
4) That the respondent sincerely regrets the incident that occurred on the alleged date before the Learned Court. The respondent respectfully submits that he never intended to tarnish the image or dignity of the Learned Judge. The incident in question occurred solely in the heat of the moment, and at no point did the respondent have any intention to insult the Learned Judge or undermine 3 the authority or dignity of the Court.
5) It is respectfully submitted by the respondent that the respondent did not intend to hurt the learned judge and the unfortunate incident occurred in the spur of moment, for which the respondent furnishes his pardon before this Hon'ble court, therefore the Hon'ble court may kindly be pleased to discharge the respondent from the instant contempt proceeding.
6) That the contemnor is a 60-year-old man and a practicing advocate in the District and Sessions Court, Ambikapur, and has been practicing for more than 30 years. The contemnor expresses his sincere remorse for the incident that occurred on the said date and undertakes that such an incident shall not be repeated in the future. The contemnor is tendering his unconditional apology before this Hon'ble Court. It is, therefore, most humbly prayed that the unconditional apology and undertaking of the contemnor be kindly accepted, and the contemnor be discharged from the present proceedings in the interest of justice."

3. The Court has carefully considered the affidavit filed by Mr. Rajwardhan Singh, Advocate, in compliance with the order dated 12.02.2026. The affidavit is taken on record.

4. The respondent-contemnor has tendered an unconditional apology before this Court, expressing sincere remorse for the incident that occurred on the alleged date. He has specifically stated that the incident took place in the heat of the moment, 4 without any intention to insult or undermine the authority, dignity, or image of the Court.

5. The Court also takes note of the personal circumstances of the respondent-contemnor. He is a 60-year-old advocate with more than 30 years of practice at the District and Sessions Court, Ambikapur. Having regard to his age, long standing in the profession, and the genuine regret expressed in the affidavit, the Court considers it appropriate, in the interest of justice, to accept the unconditional apology tendered by him.

6. Accordingly, the contempt proceedings against Mr. Rajwardhan Singh, Advocate, are hereby discharged. However, the Court issues a strict warning to the respondent-contemnor that he shall at all times maintain the dignity, decorum, and respect due to the Court. Any repetition of such conduct or breach of the undertaking given before the Court shall attract appropriate action, including initiation of contempt proceedings.

7. The affidavit of the respondent-contemnor shall form part of the record. The Registry is directed to consign the file to record accordingly.
