Heard on the question of admission as well as on interim relief.
This is an application for transfer of matrimonial matter from Family
Court, Gwalior to Family Court, Khandwa at the behest of wife.
It is stated by the counsel for the applicant that apart from the distance
from Khandwa to Gwalior there is no male member in the family and also she
has already filed an application under Section 9 of the Hindu Marriage Act, in
which the applicant and the husband-respondent is already participating. It is
also stated that the matrimonial case is filed by the respondent subsequent to filing of the application under Section 9 and it is at primary stage.
Considering the aforesaid submissions, issue notice to the respondent on admission as well as on interim relief on payment of process fee within seven working days by both modes, failing which this petition shall stand dismissed without further reference to the Court.
Till the next date of hearing, the proceedings of Case No. RCS No. 93A/2018, pending before Family Court, Gwalior shall remain stayed .
