Gated 06.04.2070 is illegal arbitrary and violative of Articles 14 and 21 of
the Constitution of India and consequently direct the respondents not to
further recover Commuted Portion of Pension in view of the petitioners
repayment of entire princioal amaunt with 8% interest and also in view of
further suffering recurring Spancial lass every month in pension and ()
direct the respondents to refund the excess amount of Commuted Portion
of Pension recovered from the petitioners frorn 136" Installment, since the
principal amount with Interest has been recovered fram the pefitioners in
135 equal monthly installments Hself

WHEREAS the Petitioners above named through their Advocate Sri
AMARTHY RATHNARAR presented this Petition under Anicie 226 of the
Constitution of Incia praying that in the cirournstances stated in the affidavit
fed therewith, the High Court may be gleased to issue an order, writ or
direction, more particularly ane in fhe nature of WRIT GF MANDAMUS
declaring that Rule 18 of Andhra Pradesh Civil Pensions (Commutation)
Rules, 1944 is ullravires ag ff provides for restoration of full pension an
campletion of 15 years of recovery of comrnuted portion of pension even
though fhe recavering of Commuted Portion of Pension fs over with
prescribed imerest rafe in 11 years O38 months and the action of
raspandants recovery of commuted parilon of pension aven though the
recovering of commuted portion of pension is over with prescribed Interest
rate and nat retaining 18 years for restoration of cormmuted value of
pension afler adopting the commutation Table-2 by increasing the rate o
interest rar 4.75% to 8% per annum vide Go.Ms.No.100, dated
O6.04 2070 is Ilegal arbttrary and violative of Articles 14 and 21 of the
Ganstiution of india and consequently direct the respondents not te further
recover Commuted Fertion of Pension in view of the petitioners repayment
of entire principal arnount with § percentage interes! and also in view of
further suffering recurring financial loss every manth in pension and
direct the respondents to refund the excess amount of Commuted Portion
of Pension recovered from the pefitioners from 158° Installment, since the
principal armount with interest has been recovered from the petifioners in
135 equal monthly installments itself:

and 19 of the Constitution of india and amounts to unjust enrichment af the
expense of the retired employees.

commuted amount of pengion beyond 14 years 3 monthe (134 months), by
which period the cammuted portion of pension is fully recovered, as Negal,
arbitrary, discriminative, irrational and unreasonable.
(c) and consequently fo direct the respondents to refund the excess
amount of commuted portion of pension recovered from the pefiioners
beyond 11 years 3 months (154 mo mike};
