The Court :- This is an application for reconstruction. It appears that, by an order dated January 8, 1996, an application for revocation of the probate granted was directed to be tried on evidence. It further appears that, by an order dated December 2, 1997 an Advocate-Commissioner was appointed for the purpose of taking evidence of the applicant for revocation.
Learned Advocate for the applicant for revocation submits that, the original records are not traceable which has resulted in the present application.2
In such circumstances, the Registrar, Original Side is directed to submit a report as to the records of the application for revocation as well as the probate proceedings on the next date of hearing. The Registrar, Original Side will submit a report as to whether the officers of Court were deputed for the purpose of taking the commission in terms of the order dated December 2, 1997 or otherwise.
Let such report be filed on December 20, 2016. List GA No. 3544 of 2016 on December 20, 2016.
