No. 11/50/96-4HB3/766. - In pursuance of the provisions of sub- section (3) of section 1 of the Transportation of Human Organs Act, 1994 (Central Act 42 of 1994), the Legislature of the State of Punjab has adopted the aforesaid Act by passing a resolution in this behalf under clause (1) of Article 252 of the Constitution of India on 17th day of September, 1996, and the aforesaid Act shall be deemed to have come into force in the State of Punjab, on and with effect from the date of its publication in the Government Gazette.Copy of the resolution passed unanimously by the Punjab Vidhan Sabha of the 17th September, 1996."Whereas the Punjab Legislative Assembly considers that it is desirable to have a uniform law throughout India for the regulation of removal, storage and transplantation of human organs for therapeutic purpose and for the prevention of commercial dealing in human organs and for all matters connected therewith or ancillary and incidental thereto;And Whereas the subject matter of such a Law is relatable mainly to entry 6 of the State List given in the Seventh Schedule to the Constitution of India;And whereas in pursuance of the revolution passed under clause (1) of Article 252 of the Constitution of India by all the Houses of the Legislatures of the Stages of Goa, Maharashtra and Himachal Pradesh to the effect that the matter aforesaid should be regulated in those States by Parliament by Law, the Parliament has enacted the Transplantation off Human Organs Act, 1994 (Central Act 42 of 1994);And Whereas, it appear to this Legislative Assembly to be desirable that the aforesaid Transplantation of Human Organs Act, 1994 should be adopted in the State of Punjab;Now Therefore, in exercise of the powers conferred by clause (1) of Article 252 of the constitution of India this House resolves that the Transplantation of Human Organs Act, 1994 should be adopted in the State of Punjab."
