                                           ORDER

           The Commission has received a petition from Shri Ram Kripal Yadav of  Ambedkar Nagar, stating that his RTI­application of 10 January 2009 filed with  the   Central   Public   Information   Officer,   Bank   of   Baroda,   Branch   Malipur,  Ambedkar Nagar, has not been responded to within the time limit prescribed  under the Right to Information (RTI) Act, 2005.  A copy of his RTI­application is  enclosed for ready reference.

2.        The Commission has decided to treat this petition as a complaint under  Section   18   of   the   RTI­Act,   2005,   and   hereby   directs   the   CPIO/Public  Information   Officer,  Bank   of   Baroda,   Branch   Malipur,   Ambedkar   Nagar,   to  provide the information sought by the Complainant by 16 June 2010. 

3.        Since the PIO has failed to respond to the RTI­application mentioned  above in time, he is, therefore, required to send his explanation in writing by 25  June 2010 to Show Cause as to why a maximum penalty of Rs.25000/­ for the  delay  in   supply  of   information  may  not  be   levied  upon  him.       If   no  written  explanation is received from the CPIO by 25 June 2010, the Commission will  decide the case ex­parte and would impose the maximum penalty prescribed  under Section 20(1) of the  Right to Information (RTI) Act, i.e., Rs. 25,000/­,  upon the CPIO/deemed PIO. If, however, the CPIO had responded in time and  provided the desired information, please let us know at the earliest.

4.               The Complainant is advised that in case he does not receive any  information from the CPIO after this order of the Commission, he may write to  the Commission against the non­compliance of the Commission's orders.

5.     The Commission ordered accordingly.
