Section 10 in The West Bengal Non-Agricultural Tenancy Act, 1949
10. Special incidents in case of misuse of non-agricultural land. -
Notwithstanding anything elsewhere contained in this Act or, in any other law for the time being in force or in any contract where any non-agricultural land held by a non-agricultural tenant or any share or portion thereof is used-(a)for any immoral, illegal or unsocial purpose, or(b)in any manner so as to become a source of grave danger to the public peace or public safety,a co-sharer tenant or the landlord of the non-agricultural tenant may, if such land or share or portion is contiguous to any land in the actual possession of such co-sharer tenant or landlord, as the case may be, apply to the Court for such land or share or portion to be transferred to himself on payment of such consideration as may be determined by the Court:Provided that if two or more persons apply under this section for such transfer, the Court shall determine the priority of the rights of the respective applicants to purchase under this section.
