ORAL ORDER
[1] Heard Shri S.M.Sojatwala, learned advocate for the applicant and Shri Mitesh Amin, learned Public Prosecutor for the respondent-State through video conferencing.
[2] By way of the present application under Section 438 of the Code of Criminal Procedure, 1973, the applicant - original accused has prayed to release him on anticipatory bail in case of his arrest in connection with C.R.No. I/11193003201713/2020 dated 11/11/2020 registered with Amreli City Police Station for the offences punishable under Sections 279,295A,34 of Indian Penal Code and Sections 11(1)(a), 11(1)(d), 11(1)(f), 11(1)(h) of the Prevention of Cruelty to Animals Act, 1960 and Sections 6(a) and 6(1)(3) of the Animal Protection Act.
[3] Learned advocate for the applicant submits that the nature of allegations are such for which custodial interrogation at this stage is not necessary. Besides, the applicant is available during the course of investigation and will not flee from justice. In view of the above, the applicant may be granted anticipatory bail.
[4] Learned Public Prosecutor appearing on behalf of the respondent-State has opposed grant of anticipatory bail looking to the nature and gravity of the offence.
[5] Considering the submissions made by learned counsels for the parties and looking to the nature and gravity of the offence, no case is made out. The application is rejected.
