Title: Need to protect the interests of the educational institutions which are run by the minority communities and are in receipt of Government Grants.
SHRI G.M. BANATWALLA (PONNANI): Mr. Speaker, Sir, it is shocking and highly objectionable that the Government has taken a stand against the rights and legitimate interests of educational institutions of the minorities. This is a shocking reversal of the policy stand taken by the Government so far. The Supreme Court is hearing several petitions. It is accepted that educational institutions cannot survive without grants, but the Government has taken a stand in the Supreme Court that educational institutions run by the minorities, which receive grants, cannot give reservations, weightage in marks or any preference to the students of the minorities in admission.

SHRI G.M. BANATWALLA : Sir, there cannot be any restriction that takes away the sum and substance of the fundamental right granted by article 30 of the Constitution, which is in absolute terms. The Minister of Human Resource Development even went to the extent of telephoning the Solicitor-General and instructed him to rebut the arguments of the Attorney-General in the Supreme Court. This is the situation.
This is all very shocking and it is an attempt to destroy all the educational institutions run by the minorities. I would urge upon the Government to protect the rights of educational institutions run by the minorities and to revise the stand that is taken in the Supreme Court against the legitimate interests of the minority educational institutions. It is an accepted fact that no educational institution can survive without grants and so they cannot be asked to surrender their fundamental rights. Therefore, the Government has to revise its policy. … (Interruptions)
