JUDGEMENT
This is a petition filed by the petitioner U/s.12 of Protection of Women from Domestic Violence Act, 2005 seeking relief's U/s.18, 19, 20 and 22 of the said Act.
2 Crl.Misc.No.103/20142. The case of the petitioner in brief is as under:
It is the case of the petitioner that she was married to respondent on Since marriage the aggrieved person and respondent lived at various places together as husband and wife and are presently residing together at the matrimonial home at R/a Flat No 2034, 3rd floor, Sobha Moonstone Apartments, Kempapura Road, Dasarahalli post, Hebbal Kempapura, Bangalore-560024 and within the jurisdictional limits of Amruthahalli Plice Station. It is submitted that out of this wedlock there are two children namely Miss Arohi born on 30 th May 2005 now aged 09 years and master Arijit born on 8th May 2007, now aged 07 years. The children are taken care of by the aggrieved person and are in her care and custody and are studying in Delhi Public School, Bangalore. It is stated that the aggrieved person was enticed by the respondent and was coerced into a sexual relationship when she was 15 years old. The respondent being 11 years older than the aggrieved person began to coerce her and threaten her saying that he will expose her and tell the world that she is a unchaste woman, the aggrieved person at the age of 18 was left with no option buy to marry the respondent. It is stated that since the date of marriage the respondent has been treating the aggrieved person with cruelty, perpetrating domestic violence including sexual, economic, verbal and physical violence upon the aggrieved person. The respondent is a habitual drunkard and a irresponsible man, the respondent had on many occasions verbally abused the petitioner in filthy language, insulting and outraging her 3 Crl.Misc.No.103/2014 dignity and even had physically assaulted the aggrieved person that resulted in causing her to suffer severe bodily pain on weeks on end. The respondent harasses the aggrieved person and keeps on finding fault with everything she does or say, the way she talks, eats her food, the way she dresses, combs her hair etc. also he takes pleasure in passing lewd remarks and statements. He has no sympathy and on the other hand seeks pleasure in torturing the aggrieved person.
The aggrieved person had no means of fending for herself and was silenced by dire threats of the respondent and hence the aggrieved person had no option but to silently bear the suffering and pain perpetrated on her by the respondent. It is submitted that in the year 1997, the respondent took the aggrieved person along with him to the United States of America, he locked the aggrieved person in the apartment and would not allow her to speak or to socialize with other persons. The respondent kept the aggrieved person under his control and would reprieve her of food at his will. The respondent then began to insult and accuse the aggrieved person of being unfaithful to him, he compelled her to cut all her family ties with her parents and friends. It is submitted that in the year 2010 the respondent relocated to India and began to demand that he start a business here. The respondent began to demand the aggrieved person bring Rs.65 lakh from her parents house so that he could start his business. The aggrieved person pleaded with respondent however futile, the respondent began to abuse the aggrieved person and accuse her of unimaginable acts. While in India 4 Crl.Misc.No.103/2014 the respondent had instructed the aggrieved person not to speak to any of the neighbors, in the month of December 2010 the respondent for nothing at all accused the aggrieved person of socializing with the neighbors and hence assaulted the aggrieved person with the roti maker. He also kicked her on her stomach causing severe pain. The screams of the aggrieved person was heard by the neighbors who came to her rescue. It is further submitted that the respondent would for no reason at all beat and kick the aggrieved person with stick, leather belt, roti maker. Dosa spoon and any object he gets in his hand etc., and also use her as a punching bag, on one such violent assault the respondent hit the aggrieved person on her head with an wooden roti maker, and caused her to loose consciousness, she woke up dazed however and pleaded for her life. The respondent told her that he will make her to suffer and rot. It is submitted that the respondent would consumer alcohol and force the aggrieved person to perform sexual acts, he would force the aggrieved person to watch pornography videos on the internet and would indulge in carnal intercourse and oral sex. The respondent would also force the aggrieved person against her wish to watch other couples indulge in live online sexual intercourse while the respondent would find pleasure in doing the same. It is submitted that he would record the sexual encounters on camera and share it with other couples. It is further submitted that the respondent would force the aggrieved person to perform oral sex for him whenever the aggrieved person refused the respondent would chase the aggrieved person in 5 Crl.Misc.No.103/2014 the house forcing himself on her. He would violently have intercourse and forcefully insert objects, articles and his hand into the genitalia of the aggrieved person. It is submitted that the respondent would deprive the aggrieved person of food for two consecutive days in a week, he would not provide food and would say that the aggrieved person is too fat and eats too much. The aggrieved person would beg the respondent to give her food however he would force her to go hungry and tell her to drink water and fill her stomach. That in the month October 2012 the father, mother and blind sister of the respondent came and began to reside in the matrimonial home. The respondent's blind sister blind. The aggrieved person was made to do all the household work, clean the toilets, cook, clean the dishes and was the clothes of all the respondent's father, mother and blind sister. The aggrieved person was forcefully made to assist the respondent's blind sister who would dirty the toilet unimaginably and pass stools in her own clothes, the aggrieved person was made to wash the filthy clothes and was put to humiliation and untold misery, suffering and also made to lower her dignity. The aggrieved person requested the respondent to provide her with a house maid so that she could get some help however the respondent began to beat the kick the aggrieved person in front of his family members, he told her that she has the status of a servant and also called her vulgar names. The father, mother and respondent for nothing at all assault the aggrieved person while the blind sister of the respondent would give constant running commentary passing abuses and 6 Crl.Misc.No.103/2014 insults against the aggrieved person. The respondent and his parents warned the aggrieved person and told her that if she takes the help of any legal authority then they will burn her alive. The aggrieved person was terrified and suffered in silence. The aggrieved person was made to sleep on the floor without a mattress, she developed severe body pain and flu. The respondent and his mother forcefully administered some unknown medication to the aggrieved person saying that she will be healed. The respondent refused to allow the aggrieved person meet a doctor. It is submitted that during the festival of Durga Pooja in the years 2013, the respondent's mother and blind sister returned to the matrimonial home. The respondent forced the aggrieved person to be a servant to his mother and blind sister. They would abuse the aggrieved person in filthy language and call her vulgar names and compare her with women of evil repute. At the same time the respondent accused the aggrieved person of stealing a gold chain from his cupboard. The respondent beat the kicked the aggrieved person in front of his blind sister and mother. The respondent tore off the aggrieved person's clothes and made her stand in from of his family members, he then began to interrogate her and forced her to confess of stealing the gold chain. All of a sudden after about two hours of torture the respondents' mother got the gold chain and handed it over to the respondent saying that she has recovered it from the aggrieved person's cupboard. The aggrieved person was made to sit at the feet of the respondent and hold his leg and be him to forgive her, all this in the presence of the respondent's 7 Crl.Misc.No.103/2014 mother and blind sister who stood and passed vulgar comments about the aggrieved person. It is submitted that since January 2013, the respondent had developed close intimacy and begun to have illicit relationship with one neighbor Mrs. Sandeepa Kaur, who is the wife of Mr. Kiran Pol, The aggrieved person had noticed that the respondent would go to the house of Mrs. Sandeepa Kaur in the absence of their husband Mr. Kiran Pol. The aggrieved person confronted the respondent however he began to assault her and threatened her with dire consequences, the respondent began to bring Mrs. Sandeepa Kaur to the matrimonial home and have intercourse. The aggrieved person was threatened and warned not to disclose to any one. The respondent had video taped and made pornography clipping of the aggrieved person, he threatened to upload it on the internet. The aggrieved person was terrified and kept silent. It is submitted that the respondent had been using the email id of the aggrieved persons and chatting with Mrs. Sandeepa Kaur who in turn has been chatting from her husband's email id. The respondent and Mrs. Sandeepa Kaur have colluded and created an alibi and have created sexual chat messages and explicit email between themselves to implicate the aggrieved person. One day Mr. Kiran Pol had inadvertently returned to his house and caught the respondent with Mrs. Sandeepa Kaur in a compromising position. The respondent attacked Mr. Kiran Pol and accused him of having an affair with the aggrieved person. It is further submitted that on the 18th Day of October 2013 the aggrieved person had gone for a walk and 8 Crl.Misc.No.103/2014 she accidentally met Mr. Kiran Pol who apologized for the sins of his wife and shameful situation that has arisen. Mr. Kiran Pol's wife Mrs. Sandeepa Kaur appeared from nowhere and physically abused, punched and kicked the aggrieved persons and accused her of having an affair with Mr. Kiran pol. The respondent then threatened the aggrieved person with dire consequences and told that she will make her life miserable. It is also submitted that the Mrs. Sandeepa Kumar had with the active connivance of the respondent has filed a criminal case registered as Case No. C-1/208 of 2014 on the file of the Chief Judicial Magistrate, Jamshedpur under various sections of the Indian Penal Code and named the aggrieved person as accused No.04 and simultaneously naming her paramount (Mr. Monojit Banerjee) as witness. The respondent has threatened to take away the children from the aggrieved person and go to USA. By his threats and by using undue influence forcefully compelled the respondent to admit that she is in a sexual relationship with the neighbor Mr. Kiran Pol. All the while the respondent recorded the forced confession of the aggrieved person. On the 5th of February 2014 the respondent went to Amruthahalli Police station and gave statement against the aggrieved person saying that she has stolen all the jewels from the house. He also accused Mr. Kiran Pol as adulterer, the aggrieved person was called to the police station and made to admit and give statement against her wish. The aggrieved person had filed application under RTI for the recovery of the statement. It is submitted that the respondent has withheld all the education documents, 9 Crl.Misc.No.103/2014 passport and jewels of the aggrieved person, he has threatened to throw her out of the house and push her on the street if she does not agree to his demands. The respondent would tutor the minor children and interrogate them and force them to admit that the aggrieved person is in contact with Mr.Kiran Pol. It is further stated that the respondent is well connected with highly influential politicians rowdy elements, police and is also in active politics. The aggrieved person has been harassed and tortured and is living in fear of loosing her life and is constantly being physically, mentally, socially, economically, emotionally and sexually abused by the respondent. It is prayed that this Honorable court may take cognizance of the complaint and pass all of the orders deemed necessary in the circumstances of the case.
Protection under section 18:
• Prohibiting acts of domestic violence by granting an injunction against the respondent from repeating any of the acts mentioned in the application. By granting an injunction against the respondent from repeating aiding or abetting in the commission of any acts of domestic violence. Prohibiting the respondents from communicating in any form, with the aggrieved person, including personal, oral or written or electronic or telephonic contact. Alienating any assets, bank lockers or bank account used by the respondent, and also not to use the locker held by the respondent and not to dispose the documents, passport, 10 Crl.Misc.No.103/2014 certificates, jewels and other items in the possession f the respondent without the leave of the Honorable Court. Causing violence to the dependents, relative, or any person who the aggrieved person who has taken for assistance.
Resident order under Sec 19. An order restraining the respondent from:
• An order directing the respondent to pay rents of Rs.25,000/- per month and maintenance charges of the premises of the shared household being Flat No. 2034, 3rd Floor, Sobha Moosestone Apartments, Kempapura Road, Dasarhalli Post, Hebbal Kempapura, Bangalore-560024. • Prohibiting the respondent or his relatives from entering the shared household of the aggrieved person. • Directing the respondent to remove himself from the shared household of the aggrieved person.
• An order directing the respondents to secure same level of alternate accommodation in Bangalore in Sanjaynagar or pay rent for the same.
• Alienating the shared household.
• Renouncing his rights in the shared household except with the leave of the Court.
Monetary relief under Sec.20 • Medical Expenses of Rs.40,000/-.
• Loss due to destruction of property from the control of the aggrieved person totaling Rs. 50Lakh.11 Crl.Misc.No.103/2014
• Physical/ mental injury suffered amounting to Rs.50 Lakh. Total Claim of Rs. 140,000,000/- (One Crore Forty Lakhs only).
• Directing the respondent to pay following expenses as monetary relief: Food, Clothes, Medication, household expenses and other basic necessities amount of Rs.50,000/- per month • Miscellaneous expenses of Rs. 25,000/-
Relief Under Sec.21:
• Granting custody of the two minor children Miss Arohi aged 09 hears and master Arijit aged 07 years to the aggrieved and • Restraining the respondent from taking away the children from the jurisdiction of this Honorable Court.
Compensation order under Section 22 amounting to Rs.100,000,000/- (One crore only).
3. After registration of the case, summons was issued to the respondent and he appeared through his counsel and filed detailed statement of objection denying each and every allegations made against him.
4. In order to substantiate their respective contentions, the petitioner got examined herself as P.W.1 and got marked 12 documents as Ex.P.1 to Ex.P.12. The respondent got examined himself as R.W.1 and got marked 7 documents as Ex.R.1 to Ex.R.7.

6. The following points would arise for my consideration.

7. On perusal of materials before this court, My findings on the above said points are as under:

POINT No.1: To file a petition U/s.12 of the Act, it is necessary that the petitioner has to establish two things firstly, she must establish that, the petitioner and respondent or respondents lived or are living together, in a domestic relationship. Secondly, that the respondent or respondents have subjected her to acts of domestic violence. To prove the domestic relationship the petitioner is required to prove that she and the respondents have lived together in a relationship of marriage or in a relationship in the nature of marriage or related by consanguinity or adoption or as family members living together as a joint family. To prove the act of domestic violence the petitioner is required o prove any one or more of the acts committed by the respondent or respondents as contemplated U/s.3 of the Act.
13 Crl.Misc.No.103/20149. In the present case the petitioner got examined herself as P.W.1 and got marked 12 documents from Ex.P.1 to Ex.P.12. The respondent has not disputed the marital status since the respondent has admitted the marriage and paternity and the relationship between the petitioner and respondent is not in dispute and hence the said point is not seriously contested.

CªÉÄÃjPÁPÉÌ ºÉÆÃzÀ £ÀAvÀgÀ £Á£ÀÄ JA©J «zÁå¨sÁå¸ÀPÉÌ PÁ¯ÉÃfUÉ ¸ÉÃjPÉÆArgÀÄvÉÛãÉ. 11. On perusal of these depositions it is clear that relationship between the petitioners and respondent is not in dispute. The petitioners have failed to prove the respondent has harassed them. However no specific allegations are being made against the respondents so as to prove the act of Domestic Violence. Mere allegations which are not specific and which are vague in nature cannot be accepted as proof of Domestic Violence.
12. When such being the case, the infliction of domestic violence made against the respondents gets diluted and same cannot be accepted. The Protection of Women from Domestic Violence Act 2005 is beneficiary legislation and is intended to protect the interest of wife. In order to claim any relief under the said Act, must satisfy and prove before this Court that she is an aggrieved woman U/s.2(a) of the said Act and she has been subjected to domestic violence as defined U/s.3 of Domestic violence Act. Hence on perusal of the evidence of 19 Crl.Misc.No.103/2014 P.W.1 it establishes that except the vague allegations made against the respondent, the petitioner has not proved her case of domestic violence against him. But petitioner and respondent have two children aged about 12 and 10 years respectively. To protect the interest of the children it is necessary to grant maintenance for the welfare of the children.
13. The petitioner has sought for a protection order restraining the respondent from committing an act of Domestic Violence. As discussed above there are no evidence to show that an act of Domestic Violence was committed by the respondent. Hence this relief is liable to be declined.
14. The petitioner has sought for a residence order U/s.19 of Domestic Violence Act, directing the respondents to secure same level or alternative accommodation for petitioner. On perusal of materials before this court, there is no evidence placed by the petitioner to prove the level of accommodation she enjoyed while she was residing with the respondent and the shared house hold. Hence the said relief is liable to be declined.
15. The petitioner has sought for an amount of Rs.1,00,00,000/- as compensation, maintenance of Rs.50,000/- p.m., medical expenses of Rs.40,000/- and Miscellaneous expenses of Rs.25,000/-. Since the act of Domestic violence is not specifically proved before this Court granting compensation would be inappropriate. But, the respondent is held responsible to pay compensation amount of Rs.5,00,000/- as 20 Crl.Misc.No.103/2014 the respondent being the husband of petitioner, he is also the father of the two children. It is his bound duty to look after the legally wedded wife and children born out of wedlock. He has to discharge his duty as husband as well as a responsible father.
16. The petitioner has prayed for an amount of Rs.50,000/- towards the maintenance of herself and her children. As discussed above by this court the grant of maintenance to the children would be in the ends of justice. Hence, an amount of Rs.6,000/- per month to each child as maintenance for their welfare would meet the ends of justice. Hence, I answer Point No.1 PARTLY IN THE AFFIRMAIVE.
17. POINT No.2: In view of the materials placed before this court, pleadings, depositions and documentary evidence, this court proceeds to pass the following:
ORDER The petition filed by the petitioner U/s.12 of Protection of Women from Domestic Violence Act 2005, is allowed in part.
The protection order U/s.18 of Act is hereby rejected.
The residence order U/s.19 of Act is also rejected.
Further the respondent is directed to pay to the petitioner Rs.5,00,000/- (Rupees Five Lakhs) as compensation.21 Crl.Misc.No.103/2014
The respondent is directed to pay maintenance of Rs.6,000/-(Rupees Six Thousand) per month to each child, born through the petitioner, from the date of petition till the said children attains the age of majority.
The claim of maintenance for the petitioner is hereby rejected.
No order as to costs.
