     These applications having been heard on 5th         December 2018, the
Tribunal on 17th December, 2018 delivered the following :

                                  ORDER

HON'BLE MR.E.K.BHARAT BHUSHAN, ADMINISTRATIVE MEMBER OA No.13/2017 and connected cases. The controversy involved in all these cases are relating to implementation of the New Pension Scheme (NPS). There are altogether 24 cases in the batch. The demand of all these cases is for regular pension and pensionary benefits as per the old Statutory Pension Scheme. All the cases except OA No.825/2017 are cases where the applicants had subscribed to the New Pension Scheme and now want to migrate to the Old Pension Scheme. OA Nos.738/2018, 771/2018, 598/2017, 672/2017, 388/2018, 637/2018 and 737/2018 are cases where 100% of the total amount in the pension fund lies with the NSDL. Also in the case of the 2 nd applicant in OA No.1088/2016, 100% of the total amount in the pension fund lies with the NSDL. OA Nos.175/2017, 602/2017, 908/2017, 949/2017, 1031/2017, 1033/2017, 1034/2017, 1058/2017, 77/2018, 154/2018 and 319/2018 are cases where 60% of the total amount in the pension fund was paid to the subscriber and only the remaining 40% lies with the NSDL. Same is the case of the 1st applicant in OA No.1088/2016 also. OA Nos.343/2017, 653/2017 and 489/2018 are cases where 100% of the total amount in the pension fund was paid to the subscriber and no amount lies with the NSDL. OA 13/2017 is concerned, it is unclear as to what happened with the amount with the NSDL.

2. OA No.13/2017 is filed by K.P.Muthukoya Vs. Union of India and others. The applicant had been initially engaged in April, 1980 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 17.09.2012. He retired from service on superannuation w.e.f. 30.04.2016.

3. OA No.77/2018 is filed by P.Mohammed Vs. Union of India and others. The applicant had been engaged initially on 11.06.1979 and was conferred with temporary status with effect from 01.09.1993. He was absorbed in regular service as per order dated 01.02.2006. He retired from service on superannuation on 31.08.2015. In the OA, it is admitted that an amount of Rs.2,51,250/- was paid to him from the NPS fund.

4. OA No.388/2018 is filed by P.P.Hamsa Vs. Union of India and others. In this case the initial engagement of the applicant was from 25.06.1983 and he was on temporary status with effect from 01.09.1993, he was absorbed in regular service as per Annexure A1 order dated 30.01.2009. He retired from service on superannuation on 31.12.2010.

5. OA No.154/2018 is filed by Adima P.V. Vs.Union of India and others. The applicant was initially engaged on 04.01.1985 and was conferred temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A2 order dated 08.02.2013. He retired from service on superannuation on .41.

31.07.2016. In para 3 of the OA the applicant admit that he was paid an amount of Rs.1,18,793.75 towards 60% of the NPS amount.

6. OA No.319/2018 is filed by A.C.Abdulkhader Vs. Union of India and others. The applicant was initially engaged on 08.03.1982 and was conferred with temporary status w.e.f. 01.09..1993. He was absorbed in regular service as per Annexure A1 order dated 08.02.2012. He retired from service on superannuation w.e.f. 31.10.2016. In the OA it is admitted that an amount of Rs.1,47,000/- has been paid to him towards 60% of the amount in the NPS fund.

7. OA No.489/2018 is filed by K.C.Hassainar Vs. Union of India and others. The applicant was initially engaged on 12.12.1979 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 12.12.2005. He retired from service on superannuation w.e.f. 30.06.2012.

8. OA No.637/2018 is filed by P.M.Abdullakoya Vs. Union of India and others. The applicant was initially engaged on 20.03.1987 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A2 order dated 06.04.2013. He retired from service on superannuation w.e.f. 28.02.2018.

9. OA No.737/2018 is filed by P.Abdul Khader Vs. Union of India and others. The applicant was initially engaged on 14.06.1980 and he was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A2 order dated 22.10.2007. He retired from service on superannuation w.e.f. 29.06.2013.

10. OA No.738/2018 is filed by A.C.Ahammed Vs. Union of India & others. The applicant was initially engaged on 01.09.1980 and he was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 31.01.2008. He retired from service on superannuation w.e.f. 29.06.2013.

11. OA No.771/2018 is filed by B.C.Hamsath Vs. Union of India and others. The applicant was initially engaged on 05.01.1981 and he was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 20.07.2008. He retired from service on superannuation w.e.f. 28.02.2017.

12. OA No.175/2017 is filed by P.P.Alimohammed Vs. Union of India and others. The applicant was initially engaged on 24.05.1979 and was conferred with temporary status w.e.f 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 28.04.2007. He retired from service on superannuation w.e.f. 31.03.2015.

13. OA No.343/2017 is filed by Nallakoya V.P. Vs. Union of India and others. The applicant was initially engaged on 15.03.1984 and he was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A2 order dated 30.09.2009. He retired from service on superannuation w.e.f. 30.06.2014.

14. OA No.598 of 2017 is filed by Mohammed M.I. Vs. Union of India and others. The applicant was initially engaged on 19.01.1980 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 28.04.2007. He retired from service on superannuation w.e.f. 30.09.2008.

15. OA No.602/2017 is filed by Abdul Khader V.P and others Vs. Union of India and others. The 1st applicant initially engaged on 25.10.1982 and he was conferred with temporary status w.e.f 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 30.01.2009. He retired from service on superannuation on 30.04.2016.

16. The 2nd applicant in OA No.602/2017 was initially engaged on 02.08.1986 and was conferred with temporary status w.e.f. 01.09.1993. H e was absorbed in regular service w.e.f. 18.08.2008. He retired from service on superannuation w.e.f. 31.08.2016.

17. The 3rd applicant in OA No.602/2017 was initially engaged on 01.03.1984 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service w.e.f. From 30.01.2009. He retired from service on superannuation w.e.f. 30.06.2014.

18. The 4th applicant in OA No.602/2017 was initially engaged on 14.06.1979 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per order dated 28.04.2007. He retired from service on superannuation w.e.f. 30.06.2015.

19. The 5th applicant in OA No.602/2017 was initially engaged on 14.06.1979 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per order dated 28.04.2007. He retired from service on superannuation w.e.f. 31.10.2013.

20. The 6th applicant in OA No.602/2017 was initially engaged on 01.04.1988 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service on 14.10.2007. He retired from service on superannuation w.e.f. 30.06.2015.

21. The 7th applicant in OA No.602/2017 was initially engaged on 24.10.1982 and was conferred with temporary status w.e.f 01.09.1993. He was absorbed in .45.

regular service w.e.f. 14.08.2008. He retired from service on superannuation w.e.f. 30.04.2016.

22. OA No.653/2017 is filed by Smt.Attabi Makket Vs. Union of India and others. The applicant was initially engaged on 23.12.1979 and was conferred with temporary status w.e.f. 01.09.1993. She was absorbed in regular service as per Annexure A2 order dated 24.04.2008. She retired from service on superannuation w.e.f. 30.09.2013.

23. OA No.672/2017 is filed by Kunnashada Koya Vs. Union of India and others. The applicant was initially engaged on 18.4.1974 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per order dated 20.09.2007. He retired from service on superannuation w.e.f. 29.04.2017.

24. OA No.825/2017 is filed by B.I.Kaderkoya Vs. Union of India and others. The applicant was initially engaged in the year 1981 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 dated 19.04.2013. He retired from service on superannuation w.e.f. 29.06.2013. He had not subscribed to the New Pension Scheme and therefore no amount is due to him from the New Pension Scheme.

25. OA No.908/2017 is filed by Koya P.P Vs. Union of India and others. The .46.

applicant was initially engaged on 01.01.1984 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A2 order dated 05.12.2008. He retired from service on superannuation on 30.06.2015.

26. OA No.949/2017 is filed by K.Pookoya Vs. Union of India and others. The applicant was initially engaged on 27.01.1983 and was conferred temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 10.05.2005. He retired from Service on superannuation on 30.05.2013.

27. OA No.1031/2017 is filed by T.K.Khalid Vs. Union of India and others. The applicant was initially engaged on 01.04.1984 and was conferred with temporary status w.e.f. 01.09.1993. he was absorbed in regular service as per Annexure A1 order dated 30.01.2009. He retired from service on superannuation w.e.f. 31.01.2017.

28. OA No.1033/2017 is filed by B.C.Kunji Vs. Union of India and others. The applicant was initially engaged on 06.11.1983 and was conferred with temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 30.01.2009. He retired from service on superannuation w.e.f. 31.07.2015.

29. OA No.1034/2017 is filed by S.Abdulla Koya Vs. Union of India. Applicant was initially engaged on 25.06.1985 and was conferred temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per Annexure A1 order dated 20.07.2008 and he retired from service on superannuation on 31.05.2014.

30. OA No.1058/2017 is filed by C.H.Ameerali vs. Union of India and others. The applicant was initially engaged on 11.04.1984 and was conferred with temporary status w.e.f. 30.09.1993. He was absorbed in regular service as per Annexure A1 order dated 30.01.2009. He retired from service on superannuation w.e.f. 30.06.2015. It is admitted in the Original Application that he was paid 60% of the amount in the NPS fund. 31 OA No.1088/2016 is filed by K.P.Cheriyakoya and others Vs. Union of India. The 1st applicant was initially engaged on 03.10.1982 and was conferred temporary status w.e.f. 01.09.1993. He was absorbed regular service as per Annexure A2 order dated 19.02.2008. He retired from service on superannuation on 31.05.2014.

32. The 2nd applicant in OA No.1088/2016 was initially engaged on 18.01.1982 and he was conferred temporary status w.e.f. 01.09.1993. He was absorbed in regular service as per order dated 08.02.2013. He retired from service on superannuation on 28.02.2014.

In all these cases the applicant relied on the final order dated 01.07.2013 in OA No.949/2010 and OA No.746/2011 of this Tribunal (Annexure A8 in OA No.13/20117) which was confirmed by the Hon'ble High Court in O.P.(CAT) No.31/2014, No.32/2014 and No.42/2013, that ruled that the applicants are entitled to get pension under the Old Pension Scheme.

After going through the submissions made by the applicants in the various OAs referred to and the reply of the respondents in respect of all cases, we see that the dispute is not of a uniform nature. Some of the applicants have withdrawn part of the money that they had deposited under the New Pension Scheme whereas some have not withdrawn any amount at all. As mandated under New Pension Scheme, the funds that were the employee's contribution, had been deposited by the employer with NSDL which was impleaded. Being a non-Government organisation per se NSDL had raised some reservations on the question of jurisdiction of this Tribunal in so far as they are concerned.

Now as per Annexure MA1 and MA2 in OA No.77/2018, it is seen that the Department of Personnel and Training, Ministry of Personnel, Public Grievance and Pension has issued clarifications as to how the old pension cases of those initially put under New Pension Scheme are to be dealt with. It is also seen that as per Ministry of Home Affairs communication (Annexure MA3) in MA No.1303/2018 (OA No.77/2018) had requested the UT Administration to settle .49.

the matter as explained in the MA1 and MA2. We direct the Respondents-2to8 to resolve all these cases within four months from the date of copy of this order. OA Nos.13/2017, 77/2018, 154/2018, 319/2018, 388/2018, 489/2018, 637/2018, 737/2018, 738/2018, 771/2018, 175/2017, 343/3017, 598/2017, 602/207, 653/2017, 672/2017, 825/2017, 908/2017, 949/2017, 1031/2017, 1033/2017, 1034/2017, 1058/2017 and 1088/2016 are accordingly disposed of. No costs.
