      This CCC is filed under Sections 11 and 12 of the
Contempt of Courts Act, 1971 by the complainant, wherein
he prays that the Hon'ble High Court be pleased to take
cognizance of the contempt committed by the accused by
disobeying the order dated 20.04.2017 passed by this
Court in Crl.R.P. No.128/2016.

    This CCC coming on for Preliminary Hearing this day,
Jayant Patel, J., passed the following:-

                        ORDER

As such it is a matter where settlement was tendered to the Court and based on the same, order dated 20.4.2017 was passed by the learned Single Judge for compounding of the offence. If the complainant finds that the agreement is not acted upon, it would be for the complainant to resort to appropriate application in the revision petition, whereby the offence was compounded. Under the circumstances, we are not inclined to initiate action under the Contempt of Courts Act, particularly when no undertaking is given.

Hence, subject to the aforesaid observation, the present contempt case is dismissed.
