Order in terms of prayers (a) and (b) of the stay petition. We formally admit the appeal.

This is an appeal under Section 37 of the Arbitration and Conciliation Act, 1996. It is against a judgment and order of a learned single judge dismissing the application filed by the appellant under Section 34 of the said Act to set aside the award.

Mr. Dhruba Ghosh, learned senior advocate appearing for the appellant, does not at this point of time pray for stay of the award for the reason that his client has been unable to secure the awarded sum.

We expedite hearing of the appeal dispensing with all formalities. As the respondent is represented by learned counsel, issuance and service of the notice of appeal is dispensed with. 2

Let informal paper books be filed by advocate-on-record for the appellant by 26th February, 2024, serving a copy thereof upon the advocate-on-record for the respondent at least seven days before the date of hearing of the appeal.

List the appeal (APOT/371/2023) under the heading "For Hearing" on 13th March, 2024.

This application (IA NO: GA/1/2023) is disposed of. As affidavits have not been invited, the allegations contained therein are deemed not to have been admitted.
