10 18-09-20231. The issue arises as to whether the second proviso to Section 23(2) of the Right to Education Act, 2009, (for brevity 'RTE Act') introduced in the year 2017, but with retrospective effect from 2015 is constitutionally valid or not.

Many of the teachers, who were appointed prior to the RTE Act and after that, before the writ court challenged their proposed termination on the ground of their having not acquired the minimum qualifications as prescribed by the academic authority notified by the Central Government, which is the National Council for Teacher Education (for brevity 'NCTE').

The learned Single Judge has classified the teachers into eight categories and answered the issues against the teachers, but, granting limited relief insofar as providing further opportunity to qualify till the date of the order. The bone of contention is with respect to the two year Diploma in Elementary Education, which is made a minimum qualification for appointment of teachers in the primary schools as per the minimum qualifications prescribed by the NCTE. The question also arises as to Patna High Court L.P.A No.748 of 2022(10) dt.18-09-2023 107/108 whether for the Standards from VI to VIII, the minimum qualification of Diploma in Elementary Education is required; which is an alternate qualification for those who do not possess B.Ed.
4. We find that a Coordinate Bench of this Court in L.P.A. No. 744 of 2022, dismissed one of the appeals filed against the common judgment of the learned Single Judge. The petitioners therein were Panchayat Teachers appointed in the year 2017, which is long after the relaxation period provided under the RTE Act. In any event, the principle applied does not distinguish the various categories of teachers as has been classified by the learned Single Judge.

Having heard the matter for sometime, we were of the opinion that to have a quietus to the issue, judicial discipline requires that the matter be referred to a Full Bench for consideration especially in the context of another Division Bench having upheld the learned Single Judge's judgment, from which many appeals are pending before us along with the writ petitions wherein the constitutional validity of the proviso now introduced in the Patna High Court L.P.A No.748 of 2022(10) dt.18-09-2023 108/108 year 2017 has also been challenged.
6. In the above circumstances, we are of the opinion that the matter be placed before a Larger Bench for consideration.
