1. The present suits have been filed under Section 105 of the Patents Act, 1970 for declaring that the making, use or sale of the article (washers) by the plaintiff does not or would not constitute an infringement of the patent of the defendant herein.
2. Mr. Anand, learned counsel for the defendant- Nord Lock AB submits that the present suits would not be maintainable. It is submitted that by way of the present suits, the plaintiff, i.e., Gala Precision Engineering Limited seeks to raise issues, which are also the subject matter of the suit filed by Nord Lock AB, i.e., CS(COMM) 895/2023.
3. Accordingly, let short note of submissions be filed by the defendant - Nord Lock AB with regard to the maintainability of the present suits.
4. Let the needful be done within a period of one week.
5. Response-submissions be filed by the plaintiff-Gala Precision Engineering Limited, within a period of one week, thereafter.
