Mr. S.D. Sanjay, learned Additional Solicitor General, seeks time to bring on record certain notification to show that the items which were sought to be smuggled into India by the petitioner were in fact prohibited items. That being so, in terms of Section 137(3)(c)(ii) of the Customs Act, the Chief Commissioner, Customs was justified in refusing the permission to compound the offence. Let him do so.
