The applicants are working as Executive Engineers (E.E.) with the respondents. They are claiming pay scale of Rs.7500-12000 (pre-revised). It is stated on behalf of the applicants that several E.E.s junior to them, have been granted the benefit of the aforesaid pay scale. The applicants further submit that their case is covered by the judgment of this Tribunal passed in O.A. No.818/2000 titled as F. C. Jain and Ors. vs. Union of India & Ors., decided on 27.09.2000 and other connected matters. The applicants have also made representations which are at Annexure A-2 (colly).
2. Heard Shri M. K. Bhardwaj, learned counsel for the applicants, Shri Rajeev Kumar, learned counsel for Union of India and Shri Nayan Dubey for Shri Gaurav Kanth, learned counsel for CAG.
3. The applicants claim the relief of placement in a higher scale of pay. For this purpose, verification of several facts becomes necessary. With the material before us, we find it 5 difficult to undertake such an exercise. The representations made by the applicants are pending with the respondents.
4. Therefore, the OA is disposed of at the admission stage, with a direction to the respondents to consider the representations of the applicants, in light of the judgment referred to hereinabove within a period of three months from the date of receipt of a certified copy of this order. Needless to mention that it shall be a reasoned and speaking order. There shall be no order as to costs.
