I.A.No.2 of 2025 Petitioner who is working as contract faculty in English at 5th respondent college since 2003. The contract was initially for a period of one year as is being extended year after year. Now the contract for the academic year 2024-25 has ended and the same is not renewed so far. Vide G.O.Rt.No.176 School Education (IE.A1) Department, 2 dated 07.05.2025, 3572 contract faculty working in various Government college faculties have been renewed/extended for the academic year 2025-26 i.e., from 01.06.2025 to 30.04.2026.

Learned counsel for the petitioner submits that in view of the general extension the same equally applies to the petitioner, therefore, the 5th respondent cannot prevent the petitioner from attending to duties by not extending the contract.

Learned Government Pleader has placed on record written instructions dated 09.07.2025 issued by the 3rd respondent inter-alia stating that as the petitioner's behavior was found to be detrimental to the institution and in spite of cautions he continued with such behavior resulting in not renewing the contract. The petitioner even refused to receive the notice issued by the 5th respondent, therefore the respondents opposed in passing an interim order.

By a general order, the Government had already extended the tenure of 3572 contract faculty working in 3 various Government Junior College for the academic year 2025-2026, which also applies to the petitioner herein. Therefore, prima facie this Court, finds that the petitioner is entitled for the said benefit. However, as the respondents have taken objection regarding the petitioner's behavior and attitude in discharging his duties and even he refused to receive the notice, petitioner is directed to receive the notices if any, to be issued, and to co-operate in the enquiry.

With such direction, the respondents are directed to continue the petitioner for the academic year 2025-26 in terms of G.O.Rt.No.176 dated 07.05.2025.
