Prayer: Writ petition is filed under Article 226 of the Constitution of
India, for the issuance of Writ of Mandamus, directing the respondents to
allot the right to occupy the shops (under construction) of Nilakottai
Town Panchayat & Taluk, Dindigul District, in the market space to the
west of Municipal bus stand and on the south of Batlagundu Main Road
only by conducting a tender cum auction sale of such right under the
Statutory Rules in a fair and transparent manner with audio video
recording of the entire proceedings in the presence of a Court appointed
Commissioner within a reasonable time as fixed by this Court.

3. The learned counsel appearing for the sixth respondent submitted that he made a RTI application and received an information to the effect that the shops are yet under construction and no shops have been let out on auction.

In reply to the above submission, the learned Special Government Pleader produced the record before this Court to establish that the shops were allotted to nearly 24 persons, after conducting auction. The learned Special Government Pleader brought to the notice of this Court paragraph No.9 of the counter affidavit filed by the fifth respondent in this regard.
5. In the light of the above development, the relief sought for in this Writ Petition cannot be granted by this Court.
6. This Writ Petition is, accordingly, dismissed. There shall be no order as to costs. Connected miscellaneous petition is closed.
