Order 14/12/2020 This writ petition has been filed by the petitioner with a grievance that the respondent No.4-School is not issuing petitioner's mark-sheet and transfer certificate as the amount of Rs.19,500/- in respect of his fees is due. (Downloaded on 14/12/2020 at 08:51:22 PM)
(2 of 3) [CW-12695/2020] It is contended in the writ petition that since father of the petitioner is a poor person and is not in a position to deposit the due fees in one go and he is ready to deposit the same in installments.
It is, thus, prayed that the respondent No.4-School be directed to issue mark-sheet and transfer certificate of the petitioner allowing him to pay the due fees in installments.
This Court vide order dated 26.11.2020 while issuing notices to the respondents has directed the respondent No.4 to issue mark-sheet and transfer certificate of the petitioner to his father immediately on depositing of Rs.5,000/-.
It is informed by counsel for the petitioner that father of the petitioner has deposited Rs.5,000/- and the respondent No.4 has issued mark-sheet and transfer certificate of the petitioner and handed it over to his father.
Learned counsel for the petitioner has submitted that he is ready to pay due amount of Rs.14,500/- in three installments, i.e. two installments of Rs.5000/- each and the last installment of Rs.4,500/- within next three months.
Learned counsel for the petitioner undertakes that the petitioner will deposit first installment of Rs.5,000/- by 25.12.2020; the second installment of Rs.5,000/- by 25.01.2021 and the third installment of Rs. 4,500/- will be paid by 25.02.2021.
Learned counsel for the respondent No.4 has submitted that he has no objection if the petitioner is allowed to deposit the due amount in installments as per the aforesaid undertaking.

(3 of 3) [CW-12695/2020] In view of the above, this writ petition is disposed of with a direction to the petitioner to pay due fees of the respondent No.4 in three installments. The first installment will be paid of Rs.5,000/- by 25.12.2020; the second installment of Rs.5,000/- will be paid by 25.01.2021 and last installment of Rs.4,500/- will be paid by 25.02.2021.
Stay petition also stands disposed of.
