O R D E R (ORAL)

By Honble Mrs. Meera Chhibber, Member (J) It is stated by the applicant that order dated 24.10.2007 was passed by the respondents against him whereby the penalty of reduction to the lower post of ASI for a period of five years was imposed on the applicant by making it clear that during this period he will earn increments of lower post and on completion of the punishment period, on promotion, increments for the intervening period shall not be restored (page 30). This order was challenged by the applicant by filing Writ Petition (C) No. 6300/2008. However, it was dismissed as withdrawn on 23.10.2008 as statutory appeal was stated to have not been filed by the applicant. Accordingly, liberty was given to the applicant to seek redressal of his grievance at the appropriate stage (Annexure P-22 page 83-A).

It is stated by the applicant that he, thereafter, filed his statutory appeal on 26.10.2008 (page 83) followed by reminder dated 19.03.2009 (page 85) and subsequent reminder on 24.08.2009 (page 86), but till date his statutory appeal has not been decided. He, therefore, had no other option but to file the present O.A.

3. We have heard counsel for the applicant. Since he has shown that statutory appeal, which is stated to have not been decided till date, therefore, this O.A. is disposed of at the admission stage itself, without going into the merits of the case by directing the respondent No.1 to decide his appeal by passing a reasoned and speaking order within a period of three months from the date of receipt of a copy of this order under intimation to the applicant.

4. With the above direction, this O.A. stands disposed of. No order as to costs.
