Heard. Learned counsel appearing for the petitioner submits that petitioner was appointed pursuant to the advertisement issued by the respondent - Management after adhering the due procedure of Law in the year 2013. It is submitted that there are three vacant posts in the respondent No. 3 - Institution. If there exists backlog of the appointment of candidates of reserve category, management can fill up those posts on the said category, however, there is no reason to deny approval for appointment of the petitioner as Assistant Teacher.
2. Issue notice to the respondents, returnable on 7 th January, 2019. Learned AGP waives service of notice for respondents No. 1 and 2. In addition to regular mode of service, petitioner to serve respondents No. 3 and 4 by alternate mode of service such as fax/e-mail/courier and file affidavit of service along with status report before the returnable date.
