ORAL ORDER
2. 07-05-2018Heard Sri Vinay Kumar Mishra, learned counsel for the petitioner and Mr. Zainul Abedin, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 27-07-2017 in Khodawandpur (Chhourahi O.P.) P.S. Case No. 122 of 2017 registered for offence under Sections 341, 323, 504, 506, 448, 307, 326, 34 of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code was added due to the reason that injured died, has prayed for grant of bail.
Learned counsel for the petitioner submits that there is no specific accusation against the petitioner. He submits that petitioner was only seen while fleeing away after the mother of the informant was poured with the acid. He further submits that one of the co-accused, in similar circumstance, has been granted Patna High Court Cr.Misc. No.27764 of 2018(2) dt.07-05-2018 2/2 bail by order dated 08-03-2018 passed in Cr. Misc. No. 62556 of 2017.
Facts remains that in the case, there was dispute in between petitioner and informant side and while mother of the informant was sleeping on a bed, she was poured with the acid and father of the informant immediately noticed that three accused persons were fleeing away. In the said case, due to acid injury, subsequently, the mother of the informant succumbed to the injuries and thereafter, charge-sheet has been submitted under Sections 341, 323, 326, 307, 448, 504, 506, 302 and 34 of the Indian Penal Code.
Since it was case of acid attack injury, injured died and there is case that petitioner was seen fleeing away, there is no reason to entertain the prayer for bail.
The prayer for bail stands dismissed.
