HARI PAL VERMA, J. (OraL) Prayer in this petition filed under Section 482 CrPC is for directing respondents no.1 and 3 to take appropriate action against the private respondents no.6 to 24 in case FIR No.103 dated 23.5.2014 under Section 379 IPC, registered at Police Station, Naraingarh, District Ambala.

The allegation against the respondents is that they have cut/harvested the standing crops of wheat and sugarcane and have stolen the same from the land in dispute despite the proceedings 1 of 2 ::: Downloaded on - 11-05-2016 00:13:27 ::: Criminal Misc. No. M-2272 of 2015 -2- pending under Sections 145 and 146 CrPC and order dated 18.4.2014 passed by District Magistrate, Ambala.

Vide order dated 18.4.2014, learned District Magistrate Ambala while exercising power under Section 22(1) and 23(2) CrPC had appointed the Tehsildar Naraingarh as Duty Magistrate for maintaining law and order problem and further directed the Kanungo and Halqa Patwari to make nishandehi of the land and deposit the sale proceeds in the Government Treasury.

Status report by way of affidavit of Shamsher Singh, HPS, Assistant Commissioner of Police, Naraingarh, on behalf of respondents no.1 to 3, has already been filed.

Learned State counsel while referring to the status report and seeking instructions from SI Sham Lal, states that in the case in hand, independent and impartial investigation was conducted by the local police and nine persons, who are named as accused, have joined investigation. Learned State counsel while referring to para 9 of the status report, submits that though on the date when affidavit was filed, the investigation was in progress, however, thereafter, on 5.11.2015, the police has completed the investigation and submitted challan against 12 persons and the trial Court has framed charges against the accused. In this manner, prayer made by the petitioner stands meticulously met with.

In view of the aforesaid, no further order is called for. The petition is disposed of.
