ORAL JUDGMENT
Date : 30-11-2021 Learned counsel for the petitioners to furnish copy of the petition to the State Counsels, to whom the same has not been served.
2. In the present petition, petitioners have prayed for following reliefs:
"I. For directing to the
respondent Bihar Staff Selection
Commission to declare the final result and recommend the name of the petitioner for appointment on the post of Driver, whereby and where under the petitioner Patna High Court CWJC No.12372 of 2021 dt.30-11-2021 26/27 completed the selection process and comes under the merit list.
II. For directing for enquire of the irregularities and illegalities committed by the Bihar Staff Selection Commission, Veterinary College, Patna to the Central agency like CBI, whereby and where under the petitioner selected in the written examination and thereafter as per the notification they are also selected for driving test and after the said selection the Bihar Staff Selection Commission prepared the merit list and the petitioner also under the merit list but only for committed irregularities in counseling the authority (B.S.S.C) not published the results to the petitioner stating that Bio- matrix thumb impression is not matched, without verifying the Video recording, C.C.T.V. footage and signature of the petitioner, which is show the bias and illegal act of the authority concerned.
III. For staying the memo no.
896/AA dated 01.04.2021, the final result of the candidates, which was issued on the basis of pick and choose method.
IV. For directing the respondents authority to verify the petitioner on the basis of C.C.T.V. footage, video recording and signature of the petitioner, which was done by the Bihar Staff Selection Commission at the time of selection process.
V. For issue direction to the respondent concerned for considers and give appointment to the petitioner.
VI. For granted any relief/reliefs for which the petitioner is entitled in the eye of law."

In the absence of representation/application before the competent authority, the grievance of the petitioners sought Patna High Court CWJC No.12372 of 2021 dt.30-11-2021 27/27 in the present petition cannot be redressed in the light of Apex Court's decisions in case of Mani Subrat Jain V. State of Haryana & Ors. reported in A.I.R. 1977 SC 276 and in case of Hari Krishna Mandir Trust Vs. State of Maharashtra reported in (2020) 9 SCC 356.
4. Accordingly, the instant petition stands disposed of reserving liberty to the petitioners, above named, to make necessary application/representation requesting the competent authority to redress their grievances to be stated in the application/representation.
5. The competent authority is hereby directed to examine the grievance of the petitioners and redress the same within a period of four weeks from the date of receipt petitioners' representation.
