ORAL ORDER
M.K.CHATURVEDI, MEMBER (A):-
As the all the petitioners are similarly situated and the relief prayed by them are common, their MA No.129/2010 praying for joining the OA No.198/2010 together, is allowed.

By this OA, 112 applicants make request to issue necessary direction to the respondents to pay them licence fee @ 10% compensation per month in lieu of rent free accommodation w.e.f. 01.07.1987 or from their actual date of posting in the State of Nagaland in conformity with the decisions of the Honble Supreme Court.

Mr.A.Ahmed, learned counsel appearing for the applicants submitted that the issue of granting lincence fee is no longer res integra, law on the subject is now trite in view of the judgment dated 08.02.2010 of the Honble Supreme Court in the case of Union of India & Ors. v. Shri Krishna Sinha & Ors. in Special Leave to Appeal (Civil) No. CC 20073-20076/2009; order dated 23.02.2005 of Honble Gauhati High Court in WP No.1569/2001; and orders of this Tribunal dated 07.04.2010 in EP No.1/2007; dated 14.11.2007 in MP No.11/2007 and 06.11.2000 in OA No.143/199. This Bench allowed OA 143/1999 vide order dated 10.06.1997 and also OA 269/2010 vide order dated 12.11.2010 and directed the respondents to pay the applicants therein licence fee @ 10% of monthly pay w.e.f. 01.07.1987 or from their actual date of posting in the State of Nagaland, whichever is later and continue to pay the same till the compensation is not withdrawn or modified by the Government of India or till rent free accommodation is not provided. It is pertinent to note that SLP preferred in the context was dismissed by the Honble Supreme Court.
4. Mr.A.Ahmed submitted that the issue in present case is identical. As such, respondents be directed to follow aforesaid precedents.
5. However, Mrs.M.Das, learned Sr.C.G.S.C. for the respondents vehemently objected the prayer made by Mr.Ahmed. It was submitted that issue in the present case is not identical. Some of the applicants were allowed to construct their bamboo hut at the defence land. As such, their case requires different treatment.

On the aforesaid objection of Mrs.M.Das, Mr.A.Ahmed submitted that earlier also applicants did file OAs for house rent accommodation before this Tribunal through OA Nos.124 and 125 of 1995 and respondents in their reply made objection as to the entitlement of HRA to the applicants on the ground that applicants were given permission to construct temporary accommodation on defence land, but this Tribunal rejected their ground by giving direction to the respondents that applicants are entitled to payment of HRA and those judgments were affirmed by the Honble Supreme Court in Civil Appeal No. 1572 of 1997 vide order dated 17.02.1997.
7. I have perused the material available on record and the judgments relied upon by the learned counsel. Ex facie, issue is identical. I, therefore, direct the respondents to decide the present issue in accordance with aforesaid precedents after examining the facts within a period of two months from the date of the receipt of this order.
8. OA stands disposed of accordingly. No costs.
