The complaint dated 04.07.2012 moved by the petitioner- Baldhir Singh was treated as present Criminal Writ Petition. After perusal of the complaint, notice of motion was issued to the respondent-State.
Reply, by way of affidavit dated 30.07.2012 of Gurnam Singh, PPS, Assistant Commissioner of Police (North) Amritsar City, on behalf of respondent-State of Punjab, filed in the Court today and the same is taken on record.
Learned State counsel submits that the alleged detenue Gurpreet Singh son of the petitioner was neither wanted in any case nor any case was found registered against him. Thus, learned State counsel submits that the present petition is wholly misconceived and the same is liable to be dismissed.
I have heard learned State counsel and with his able assistance have gone through the record of the case. Para No.2 of the reply, by way of affidavit dated 30.07.2012, reads as under:
"That it is further submitted that Gurpreet Singh son of the petitioner is neither wanted in any case nor any case is Criminal Writ Petition No.1229 of 2012 2 registered against Gurpreet Singh son of the petitioner at Police Station, Civil Lines, Amritsar, at present. Thus, there is no occasion for the police of PP Faizpura, PS Civil Lines, Amritsar, for illegal custody/arrest of Gurpreet Singh son of the petitioner. Thus the petition deserves to be dismissed on this ground."

In view of the above, the instant petition does not survive and the same is ordered to be disposed of, as having been rendered infructuous.
