Considering the urgency pleaded by the petitioners in the application filed under CAN 4294 of 2020, the writ petition is taken up for hearing through physical appearance.

Accordingly, the application being CAN 4294 of 2020 is disposed of.

The grievance of the petitioners is that they imported large quantity of bitumen which arrived at Haldia Port on or about June 7, 2020 and the bill of entry and other relevant documents relating to releasing of goods were duly submitted by the petitioners. The petitioners allege that despite payment of customs duty, the respondents no. 2, 3 and 4 have failed and neglected to 2 release the goods within the stipulated period of time which has caused loss of revenue to the petitioners.

Respondents no. 1, 2 and 6 are represented, but the other respondents remain unrepresented. The contention of the petitioners is disputed by the appearing respondents. The respondent no. 6 submits that it is ready and willing to release the goods provided such instruction is conveyed to it by the customs authority and the charges due from the petitioners are met prior to release of the goods.

Let a report be called for from respondents no. 2, 3 and 4 with regard to the contention of the petitioners by the next date of hearing.

Let the matter stand over till August 13, 2020. As the respondents no. 3 and 4 are not represented, let a copy of this order be served upon the said respondents by the petitioners at the earliest.
