                          Writ petition is filed under Article 226 of the Constitution of India
                seeking for issuance of a writ of mandamus to direct the respondents to survey
                the land in survey No.349/2A1A1, with an extend of 5.54 acres, at
                Marudhandapalli village, Shoolagiri Taluk, Identify                          and demarcate the
                boundaries of the land, by considering the petitioner’s representation dated
                03.12.2025.

                                                               ORDER

This writ petition has been filed seeking for a direction to the fifth respondent to survey and demarcate the property, which according to the petitioner is owned by him, within a time frame to be fixed by this Court.

2. The petitioner had submitted a representation dated 03.12.2025 seeking for survey and demarcation of the property morefully described in the prayer to this writ petition. Since the said representation has not been considered till date, the petitioner has filed this writ petition.

3. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents 1, 3 and 5.

4. No prejudice will be caused to the fifth respondent, if the aforesaid representation of the petitioner is considered, on merits and in accordance with __________ Page2 of 4 https://www.mhc.tn.gov.in/judis ( Uploaded on: 28/01/2026 08:21:04 pm ) WP No. 1551 of 2026 law, after hearing objections if any from the neighbouring land owners as well as any other party whom the fifth respondent deems fit to enquire. Accordingly, this writ petition is disposed of in the following manner:-

(a) Before surveying the land in question, the fifth respondent is directed to issue notice to the neighbouring land owners, and also to any other party, whom the fifth respondent deems fit to enquire.
(b) After receiving objections if any and after considering the same, the fifth respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.
(c) If any need arises, the fifth respondent is permitted to submit a petition for police assistance, and upon receipt of such request, the sixth respondent shall render necessary police assistance for conducting survey and demarcation of the subject property.
