Appeal has been registered twice by the Central Registry of CIC.
Information sought:
The Appellant wanted to know according to which rule/Act (with date and name of department that issued the order) Land Grant Rules (LGR) Patta can be executed as sale deed in the name of the legal heir of the LGR Patta beneficiary with the consent of the LGR Patta beneficiary.
Grounds for the Second Appeal:
The CPIO has not provided the desired information.1
Relevant Facts emerging during Hearing: The following were present:-
Appellant: Present through VC.
Respondent: C. Sendhilkumar, Tehsildar (Settlement) & PIO, O/o Tehsildar (Settlement), Directorate of Survey & Land Records, UT of Puducherry present through VC.
Appellant stated that he is not satisfied with the reply of the PIO.
PIO submitted that Appellant has been appropriately informed that no order on the subject mentioned in the RTI Application is available and hence cannot be provided.
Decision Commission observes that the Appellant is seeking PIO's interpretation/clarification regarding a revenue order which is not covered under Section 2(f) of the RTI Act and upholds the submission of the PIO.
Commission advises the Appellant to approach the public authority directly for such clarifications on revenue matters.
The appeal(s) are disposed of accordingly.
