IN THE HIGH COURT OF ANDHRA PRADESH :: AMARAVATI

THE HON'BLE SRI JUSTICE NINALA JAYASURYA

               WRIT PETITION No.27248 of 2023

                       Dt.16.10.2023

Between:
Golla Ramesh Chowdary
                                                  .... Petitioner
     And
The State of Andhra Pradesh,
Rep. by its Principal Secretary,
Revenue Department, and Others.
                                                ..... Respondents

Counsel for the petitioner : Mr.Pavani Siva Kumar

Counsel for respondents : The G.P. for Revenue

ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for the respondents.

2. The grievance of the petitioner in the present writ petition, in short, is that despite making representation dated 14.8.2023 for mutation of his name in the Revenue Records and issuance of Pattadar Pass Book and Title Deed (PPB/TD), as per the Partition Deed of the petitioner, in respect of the land of an extent of Acs.31.85 cents in Survey 2 No.145 of Kambaladinne Gram Panchayat, Siddavaram Revenue Village, Pamuru Mandal, Prakasam District, so far no action has been taken by the 4th respondent.

3. Though the learned counsel for the petitioner sought to advance arguments with reference to the averments made in the writ petition and the material filed along with the same, learned Assistant Government Pleader for Revenue, at the time of considering the matter, points out that the petitioner appears to have made a representation 14.8.2023 seeking mutation of his name in the Revenue Records, instead of making application through online. He submits that in such circumstances the request of the petitioner cannot be accepted. He also submits that if the petitioner makes online application for mutation of his name in the Revenue Records in the concerned Grama Sachivalayam, as per the procedure in vogue, necessary action would be initiated by the concerned Authority, in accordance with Law.

4. Considering the submissions made, this Court, instead of keeping the writ petition pending, deems it appropriate to 3 dispose of the same, leaving it open to the petitioner to make Online application seeking mutation and issuance of PPB/TD in respect of the subject matter property. On receipt of such application, the 4th respondent shall take necessary action on the same, in terms of the provisions of the provisions of the A.P. Rights in Land and Pattadar Pass Books Act, 1971, as amended by Act 15 of 2022 (published in A.P. Gazette on 18.10.2022), within a period of four (4) weeks from the date of receipt of the application.

5. With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
