hit pctii ncr has a1led r qrnstion the crdcr c . tpcnd t. 2 ( 0 Cl I -3- allotment Is made in favour of the petitioner, a cow of which Is produced at Annexure B'. The petitioner after allotment of the said plot had transported 11,000 metric tonns of iron ore fines to be exported out of the country. Thereafter. the petitioner could not undertake the transportation of the Iron ore fines on account of the statutory order passed by the Deputy Commissioner, Hassan District, prohibiting the movement of the lorries and also the orders of the Government dated 28.07.20 10 directing the Deputy Director of Mines and Geology, not to Issue the mineral despatch permits for export purposes. Having regard to the statutory orders. the petitioner was not permitted to transport the iron ore fines from the stockyard to port area allotted to the petitioner. It is to be noticed that since the petitioner did not comply with the conditions of the allotment, Annexure A' has been Issued terminating the allotment and further directing the petitioner to pay the penal rents.

the said penal licence fee, the petitioner will be permitted to export the iron ore subject to terms and conditions of the order passed by the Apex Court In the extract above.
The respondent shall monitor such exports further.
It is open for the respondents to repossess the plot after the expiry of the licence period.
Petition stands disposed of accordingly.
