Das, Revenue file this appeal against the order of the Commissioner (Appeals). After hearing both the sides and on perusal of the records, we find that the Adjudicating authority confirmed the demand of duty of Rs 5,255/- alongwith interest and penalty. The Commissioner (Appeals) set aside the Adjudication order. After considering the findings of the Commissioner (Appeals), we do not find any reason to interfere the order of the Commissioner (Appeals). Accordingly, the appeal filed by the Revenue is rejected.
