This is a first bail petition under Section 438 read with Section 482 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR no.241 dated 24.09.2022 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act 1985 (in short "NDPS Act") (Section 29 NDPS Act added later on) at Police Station Divisoin no.5, Ludhiana.

Learned counsel for the petitioner, after arguing for some time, seeks to withdraw the present petition and states that the petitioner is ready to surrender before the police within a period of 15 days and prays that in case the petitioner applies for regular bail after surrender, the same be decided as expeditiously as possible, preferably within a period of 7 days.

Learned State counsel has opposed the bail application, however, does not object to the said course of action.

Keeping in view the above said statement made by learned 1 of 2 ::: Downloaded on - 25-11-2022 17:02:03 ::: CRM-M-54771-2022 2 counsel for the petitioner, the present petition is dismissed as withdrawn, with a direction to the petitioner to surrender before the police within a period of 15 days and in case after surrendering, the petitioner files an application for regular bail, the trial Court is directed to decide the same expeditiously, preferably within a period of 7 days from the date of the said application being moved.
