Ms. Ginita Bodani i/b Economic Laws Practice for Petitioner.

                                          NEELA GOKHALE, JJ.

DATED : 4th OCTOBER 2023 P.C. :

1. On 29th September 2023 the court pointed out to petitioner's counsel that the verification clauses are blank. It was also pointed out that the Board Resolution based on which Mr. Ameet Ramdeo Sharma has signed and verified the petition does not authorise him to even engage an advocate. At the request of counsel we placed the matter today to enable petitioner to rectify the defects. On 30 th September 2023 the Registry was working and so also on 3rd October 2023.
2. Ms. Bodani states that the Board Resolution is ready but the authorised signatory had some personal difficulty. We do not accept that explanation.
3. Stand over to 5th October 2023.

4. We would still give one more opportunity. The defects will be rectified by this evening or early tomorrow morning failing which the petition will be dismissed with further no time being granted. For today's adjournment petitioner shall pay a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to respondent by cheque drawn in favour of Pr. CIT (Central) - 1, Mumbai and this amount shall be paid by tomorrow.

5. We have to also note that petition was listed on 31st July 2023 when directions were passed. Petitioner should have been aware that they have filed defective petition and authorised signatory had even not read the petition or applied his mind to the petition.

(NEELA GOKHALE, J.) (K.R. SHRIRAM, J.)
