29/V/Pt-49923/OAC 24068/2021-22/10235, dated 09.07.2021, and the
consequential proceedings of the third respondent in No. Pension 1/2022,
dated 22.01.2022 and quash the same.

ORDER
The instant Writ Petition has been filed by a retired Assistant Training Officer, challenging the order passed by the first respondent and the consequential order passed by the third respondent, on the ground that before effecting reduction in pension, he was not heard.
2. A perusal of both the impugned orders indicates that before passing the said orders on 09.07.2021 and 22.01.2022, the petitioner has not been heard. Since these orders would have adverse effect on the pensionary ____________ Page 2 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD) No.13280 of 2022 benefits of the writ petitioner, the orders are liable to be set aside.
Accordingly, the orders impugned in the Writ Petition are set aside and the matter is remitted back to the first respondent to pass orders afresh on merit and in accordance with law, after affording due opportunity to the writ petitioner.
3. Writ Petition is allowed accordingly. No costs. Consequently, the connected W.M.P.(MD) No.9433 of 2022 is closed.
