Background
1. The Applicant filed a RTI application dt.5.9.08 with the CPIO, DoP, Osmanabad. He requested for the following information:
i) copies of all office notes of dealing accountant after receipt of report of ASP(N), Latur dt.4.5.01 along with copies of orders passed on it by the then Supdt. Shri D.S.Kulkarni till 31.5.01 on which fresh report to ITO (TDS) Nanded is made without previous reference through ASP (N) Latur
ii) copies of OM dt.5.11.98, 5.11.99 and 31.10.2000.
On not receiving any reply, he filed an appeal dt.5.10.08 with the Appellate Authority. The Appellate Authority replied on 5.11.08 directing the CPIO to trace the information and supply it or else give reasons for non- availability of the information to the applicant. Aggrieved with this reply, the Applicant filed a second appeal dt.3.2.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for April 15, 2009.
3. Mr. S.N. Shastri, IP, Udgir Sub Divn and Mr. S.N. Ambekar, IP, Latur Divn.
represented the Public Authority.
4. The Applicant was present during the hearing.
Decision
5. The Appellant submitted that he received the information on 8.4.09 and that it is incomplete. The Commission advises the Appellant to provide the Respondent with a list of the missing information and the CPIO is directed to provide the missing information within 15 days of receipt of the list from the Appellant. All information is to be provided before 10th May, 2009.
6. The CPIO is also directed to show cause as to why a penalty of Rs.250/- per day should not be imposed on him for not providing the information within the mandatory period. The response to reach the Commission by the end of April, 2009.
7. The appeal is disposed off.
