              WRIT PETITION No.18190 of 2023

ORDER:

The grievance of the petitioner in this writ petition is that without registering any case against him, the respondent-police are harassing him by frequently calling him and his family members to the police station and also made them to sit hours together.

2. It is the contention of the learned counsel for the petitioner that respondent No.4, who is the daughter-in-law of the petitioner, has approached the police and at her instigation even without registering any crime, the respondent-police are frequently calling the petitioner and his family members to the police station.

3. The learned Assistant Government Pleader for Home has submitted that respondent No.3 has received a complaint from respondent No.4 and as the said complaint revealed cognizable offence, a case in Crime No.48 of 2023 has been registered against the petitioner for the offences punishable under Section 498-A of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961 and for the 2 CVBR, J Wp_18190_2023 purpose of investigation only, the respondent-police are summoning the petitioner and they have not harassed the petitioner in any manner.

4. In view of the said submissions, this Court, deems it appropriate to dispose of the writ petition, directing respondent No.3 to follow the procedure contemplated under Section 41-A of Cr.P.C. and the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

5. With the above observations, this Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
